국문 초록

지하공간은 한번 개발되면 다시 개발하기 힘든 특성이 있다. 지하공간의 시설물은 지하시설물, 지하구조물, 지반으로 구분된다. 그러나 최근까지도 지하공간에서 각종 사건, 사고가 발생하고 있어 국가에서는 지하 안전관리에 관한 특별법을 제정하여 지하공간 통합지도를 제작·구축하고 있다. 아울러 지하공간의 토지소유권에 대하여 민법은 그 범위를 정당한 이익이 있는 토지의 상·하로 규정하고 있다. 따라서 정확한 토지등록과 토지소유권 보호를 위해서는 지하공간에 설치되는 시설물과 토지 경계가 동시에 등록되어야 한다. 또한 정확한 등록을 위하여 토지 경계가 표시되는 도면에 지하시설물 계획선이 같이 표시되는 방법과 절차를 제시하였다. 지하시설물이 토지 경계가 표시된 도면에 등록된다면 ‘정확한 위치등록과 토지소유권 보호’라는 두 가지 목적을 달성할 수 있을 것으로 기대된다.

영문 초록

Underground space has characteristics that are difficult to re-develop once developed. Facilities in underground spaces are divided into underground facilities, underground structures, and ground. However, since various incidents and accidents have occurred in underground spaces until recently, the government has enacted a special law on underground safety management to produce and construct an integrated map of underground spaces. In addition, with respect to land ownership in underground spaces, the Civil Act stipulates that the scope of land ownership shall be upper or lower than that of land that is reasonably beneficial. Therefore, facilities and land boundaries installed in underground spaces should be registered simultaneously to ensure accurate land registration and protection of land ownership.Also, for accurate registration, the method and procedure for the planning line of underground facilities to be displayed in the drawings where the land boundary is displayed were provided. It is expected that if underground facilities are registered in the drawings marked with the land boundary, two purposes can be achieved: accurate location registration and protection of land ownership.
