가석방 결정에 대한 제도적 고찰과 규범적 문제점을 지적하는 연구들은 간간히 등장하였지만 경험적으로 가석방 요인을 분석하고 그 유의미한 요인을 밝혀낸 연구는 거의 없다. 본 연구는 교도소내에서 구분하고 있는 사범유형에 따라 가석방 결정요인이 상이한가를 확인하고자하는 큰 연구목적으로 진행되었다. 가석방 결정여부에 영향을 미치는 요인과 잔형기간(비율)에 영향을 미치는 요인을 함께 분석하고자 하였으나 가석방 결정 자료에 대한 접근권한 한계로 인하여 보호관찰 대상자들의 보호관찰 사안조사서를 통해 교정기관에서 이관된 항목들을 추적한 항목들을 코딩하여 총 477명의 자료가 수집되었다. 연구에 활용된 종속변수는 잔형비율과 잔형기간이며, 독립변수는 개인적 요인, 법적 요인, 그리고 수용태도요인으로 크게 분류하여 활용하였다. 이러한 변수 선정에 근거가 된 이론들은 초점적 관심이론과 비판범죄학 그리고 국외의 선행연구 결과이다. 연구결과, 가석방 결정에는 사범유형별로 다른 요인들이 유의미하게 작용하며 법적요인(선고량)과 교도소내 태도(벌횟수)가 유의미한 영향력을 발휘함을 발견하였다. 그러나 영향력의 상대적 크기는 법적요인의 영향력이 훨씬 강력하였다. 더욱 구체적인 연구방법과 결론, 정책적 함의들은 본문을 통해 논의하도록 한다.

영문 초록

There are no remarkable empirical research which analyzed the significant factors of parole decision in South Korea. The purpose of this study was to determine if the parole determinants are different by type of offenders in prison and what is the decision criteria between the remaining patio or remaining period. Eventhough the research hoped to analyze the collected data from the parole board, the data clearance was limited. The used data was collected from probationer individual case card of the probation office, and the information included the demographic factors, crime seriousness, and attitudes during the prison transferred from correctional facilities. A total of 477 data were collected by the coding the items tracked. The dependent variable used in this study was remaining ratio of the sentence, and independent variables ere classified into personal factors, crime seriousness factors and attitudes in the prison. Theories based on the selection of these variables are from the focal concern theory, critical criminology and previous studies in other countries. as a result, it was found that factors were significantly different by the type of offenders. and we found the legal factors and attitudes in prison had a significant influence on parole decision. however, the relative magnitude of influence of attitudes in prison was much stranger than crime seriousness. more specific research methods, conclusion, and policy implication will be discussed in the text.
