범죄수익환수 관련 법률의 입법동향 및 향후 과제

국문 초록

최근 범죄수익환수에 대한 관심이 높아지고 있으나 관련 법률은 통일적으로 규율되어 있지 않고 여러 법률에 분산되어 있다. 본고에서는 이중 입법논의가 활발히 진행되고 있는 범죄수익은닉규제법, 부패재산몰수법을 중심으로 범죄수익환수에 관한 입법 동향을 살펴본다. 범죄수익은닉규제법과 관련하여서는 2019. 4. 23. 개정된 법률의 개정배경과 주요 내용을 검토하고 이와 관련하여 최근 입법 동향 및 향후 과제를 알아본다. 우리 범죄 수익은닉규제법은 범죄수익환수 대상을 지속적으로 확대하는 방향으로 개정되어 왔으며, 향후 입법과제로 기준식 접근법을 활용하는 방안과 법정형을 상향하는 방안을 제시하였다. 부패재산몰수법은 2019. 8. 20. 개정된 법률의 개정배경과 주요내용을 살펴보고 이를 바탕으로 범죄피해재산 몰수와 관련된 정책적 필요성 및 그 허용범위를 검토하였다. 또한 개정법률의 내용대로 범죄피해재산에 대한 몰수․추징을 확대할 경우 피해자 환부 절차를 보완하기 위한 시행령의 개정을 향후 과제로 제시하였다. 최근 입법동향을 통하여 우리 범죄수익환수 법제가 범죄수익은닉규제법상 중대범죄를 확대하고, 범죄피해재산에 대한 몰수를 허용하는 등 범죄수익환수를 확대하는 방향으로 개정되고 있음을 확인하고, 관련 법제의 통일적 규율을 위한 법제 정비의 필요성을 강조하였다.

영문 초록

Despite the increasing interest in criminal asset recovery, the relevant laws are not governed under uniform regulation, but are dispersed across various legislations. This study explores the legislative trends of criminal asset recovery, with a particular focus on the Act on Regulation and Punishment of Criminal Proceeds Concealment and the Act on Special Cases Concerning the Confiscation and Return of Property Acquired Through Corrupt Practices – the bills of which have been subject to an ongoing and lively discussion on double legislation. With regard to the Act on Regulation and Punishment of Criminal Proceeds Concealment , I analyze the background behind, and the major changes stemming from its amendment on April 23, 2019, while also investigating the recent legislation trends and future tasks to be carried out. Previous amendments have been in the direction pertaining to the continuous expansion with respect to the scope of criminal asset recovery and future legislative tasks, including measures to utilize the threshold approach and to increase the statutory punishment, are proposed. Concerning the Act on Special Cases Concerning the Confiscation and Return of Property Acquired Through Corrupt Practices , I likewise assess the background behind, and major changes included in the government proposal for the revision, which has been submitted to, and is under discussion at the National Assembly. Based on the assessment, the need and the permissible scope for a policy addressing the forfeiture of criminal assets are considered. Further, subsequent amendment to the respective Enforcement Decrees to supplement the procedures for the distribution of criminal proceeds recovered is proposed as a future task, in case the scope of the forfeiture against criminal assets is expanded in accordance with proposal submitted. Through the assessment of recent legislative trends, Korea’s legal initiatives to expand the scope of criminal asset recovery by expanding the scope of serious crimes stipulated under the Act on Regulation and Punishment of Criminal Proceeds Concealment and allowing the forfeiture of criminal assets are confirmed, and the need for a legislative reform for a uniform regulation of the relevant laws is underscored.
