국문 초록

현재, 대학의 폐교처분에 따른 법리와 법률 또한 정비되어 있지 않다. 국립대학은 통합의 형식으로 사립대학은 합병절차라는 통합의 형식으로 대학간 구조조정을 하고 있는 것이 보편적이다. 이러한 통합절차는 많은 문제점을 안고 있다. 그러므로 국립대학과 사립대학의 구조조정이 용이하고 대학경쟁력제고를 가져오기 일환으로 가칭 대학통합및폐교에관한특별법 을 제정하는 계기를 마련하고자 함이다. 초등학생 취학률과 18세 대학적령인구의 급감으로 오는 대학의 위기를 그대로 방치하는 것은 대학의 줄 도산을 예견하는 일이다. 이는 대학구성원의 문제를 벗어나 고등교육의 파행은 물론, 온 국민이 떠안아야 할 세금으로 다가 오게 되는 것이다. 이러한 문제점을 해결하기 위하여 법률제정으로 해결하는 것은 매우 중요한 일일 것이다. 본고에서는 이를 해결할 수 있는 이론적 단초를 제공하게 될 것이다.

영문 초록

Other principles of law and laws aren`t provided a disposal of a university closing of a school with at present. A private university is doing the form of the integration as a university merger, and a national university is doing a structural adjustment between the university. Such integration procedure is holding many problems. Therefore I think a structural adjustment of a national university competitive power will be brought, and I will prepare the opportunity which establishes a tentative name Law about university integration and closure . To leave a crisis of the university which comes by a rapid decrease of the university suitable age population, 18 years old and the percentage of elementary schoolchild attendance expects bankruptcy of a university. Out of a problem a university member, this will come up to a higher education bankruptcy and a tax by which everyone has to have the people. It will be very important to settle it by law establishment to settle the problems. The theoretical beginning which can settle it will be offered by the article.
