국문 초록

이 글은 일본, 미국, 독일과 영국(잉글랜드)을 대상으로 하여 이들 국가들의 대학의 거버넌스를 법적인 측면에서 구체적으로 비교 고찰함으로써 한국의 국립대학 법인화 추진 등 대학의 거버넌스 개혁에 대한 시사점을 얻고자 시도되었다. 구체적으로 대학의 거버넌스에 관한 근거법의 체계와 내용에 대한 분석을 통해 대학의 거버넌스를 법적으로 어떻게 규율하고 있는지, 대학의 의사결정기구는 무엇이며, 여기에 누가 어떻게 참여하고 있는지, 그리고 개별대학은 어떻게 설립되고, 어떤 법적 지위를 갖고 있는 지를 비교하였다. 또한 대학의 의사결정에 직접적으로 영향을 미치는 국가나 주 정부와의 관계를 제한적인 범위에서 살펴 보았다.

영문 초록

There have recently been important changes in governance structures of universities in many developed countries. Since higher education is widely recognised as a key to national economic competitiveness and overall prosperity, the state is justified to define a vision for higher education and set strategies to achieve that vision. This study examines various visions brought out by recent changes in legal frameworks and governance structures of universities to apply suggestion for Korean university reform such as transforming Seoul National University into a National University Corporation. For that purpose, four countries have been chosen for case studies: Japan, Germany, U.S.A. and England. To be specific, this study analyzes structure of legal system for university governance in those countries` universities in order to compare as follow questions. First, how does the legal system regulate the university governance? Second, how does the legal system establish legal status of universities? Third, what is the ultimate decision making body, who and how can participate in it? In addition, this study with reference to these cases offers various approaches to establishing legal policies concerning the governance structures of Korean universities.
