미국 홈스쿨 법제에 관한 연구

지식정보사회에서 학교의 변화에 대한 다양한 예측들과 이명박정부의 고교다양화 정책 등을 살펴볼 때, 학교의 역할 변화뿐 아니라 학교의 형태에 대한 변화가 예측된다. 그러나 최근의 이와 같은 논의들은 아직 공교육제도의 전제하에서 공교육을 개선하고 정상화하려는 노력에 그치고 있을 뿐, 탈학교교육으로서 홈스쿨에 대한 논의는 미비한 형편이다. 이 글은 미국, 영국, 독일 등 여러 교육선진국에서 홈스쿨이 활성화 되어 있지만, 특히, 홈스쿨이 활성화되고 어느 정도 법적 안정화가 되어 있는 미국 주정부의 다양한 법률과 판례의 법리를 분석해 봄으로써, 장차 홈스쿨에 대한 우리 법제는 어떠해야 할 것 인지를 조망해 보고자 하였다. 물론 미국의 경우에도 홈스쿨과 관련하여 지금까지도 많은 법적 분쟁이 발생하고 있고 다양한 법리가 만들어지고 있으나, 그 핵심은 교육을 받을 권리와 부모의 교육권 특히, 학교선택권의 의미를 우리와는 좀 더 다른 시각에서 바라보고 있는 것으로 파악되었고, 가장 핵심적인 분쟁의 소재는 주정부의 홈스쿨에 대한 필요하고도 최소한의 규제의 범위를 어떻게 설정할 것인가의 문제로 귀결된다. 이와 같은 시사점을 통해 좀 더 학생들에게 바람직한 교육기회를 제공해 주는 방법이 무엇인지에 대해 다시금 생각해 보는 기회가 되었으면 한다.

영문 초록

Our country has about 1,000 Family introduce home-school, but we have no legal system to apply for home-school. The department of education in S. Korea declares home-school will be introduced to educational system for the diverse certification of scholarship in 2007, but not yet. This research is for examining what legal-base and legal theory are needed for introducing home-school in the Korea educational system and what problems will be happen to introduce Home-school in S. Korea compulsory education law? Home-school as the right of parent to educate their children is based on 14th amendment of due process clause and some parent assert that home education right is based on free exercise clause in 1st amendment, and that privacy right. States have the compelling interest to education in two folds: politic and economic, so state and school superintendent want to regulate home-school to require a few means for the name of state compelling interest. S. Korea Constitution has no explicit reference on parent`s right to education, but parents should have a role to direct their children`s education under 31th and 36th article of constitution. However, Constitution Court states that compelling interest is more important than parent`s right to education, whose children is under compulsory attendance law. In real life, there are 1,000 families to do home-school in our county. So, I think if home-school is allowed to Korea educational system, we need to review again the meaning of the parent`s right to education and choice of education method under Constitution.
