국문 초록

개인이 표현하는 의견은 인간 이성(理性)에 대한 인식을 바탕으로 하는 정신적 자유의 하나로서 헌법은 표현의 자유를 규정하고 있다. 오늘날 정보사회에서 컴퓨터와 결합되는 다양한 전자매체는 대중의사소통을 위한 소통의 공간으로 활용되면서 헌법, 또는 언론법의 차원에서 이론과 제도 등 여러 측면에 관하여 새로운 법적 논의를 불러일으키고 있다. 이 연구는 인터넷이라는 가상공간에서 ‘표현의 자유’ 확장을 위하여 ‘악성 댓글’에 대한 규제방안을 네티켓 교육을 통한 자율적 측면을 중심으로 고찰함으로써 인터넷 가상공간에서의 건전한 의사소통 방안을 제시하는 것이 목적이다. 연구목적을 달성하기 위하여 인터넷상 악성 댓글과 관련된 표현의 자유에 대한 이론을 검토하고, 그 법적 규제 방안과 자율적 규제방안을 고찰한다. 일반적으로 인터넷상에서 규제는 강한 법·제도적 접근도 필요하지만, 민간의 자발적인 협력과 국제적 협력이 수반될 때에만 실효성을 얻을 수 있다. 선진국의 인터넷 악성 댓글에 대한 자율규제 동향은 인터넷 관련 산업의 촉진과 소비자 보호라는 측면에서 정부가 적극적으로 자율규제를 장려하고 민관의 협력적 관계를 촉진하는 데에 중점을 두고 있다. 그러나 우리나라의 인터넷 규제방식은 과도한 직접 규제방식을 채택함으로써 헌법적 기본권과 층돌양상을 보이고 있으며, 현실적으로 강제 집행력의 미약 내지 구제수단의 미비로 인하여 법·제도적 규제방식의 선택을 강요하는 구조적 한계를 보이고 있다. 정부의 규제입법은 업계에 부담이 되지 않으면서도 필수적인 보호수단을 제공할 수 있어야 한다. 이 점에서 인터넷 규제입법은 규제기관의 탄력적 규제권한이 포함되어야 할 것이다. 따라서 인터넷 악성 댓글 문제의 해결은 엄격한 법·제도적 규제보다는 시민, 즉 네티즌의 자율적 이성을 강화하는 윤리적 규제에 초점을 맞출 필요가 있다 이를 위한 미디어 교양(media literacy) 교육의 일환으로 이른바 네티켓 교육의 강화를 포함한 정책적 지원이 요청된다.

영문 초록

In the knowledge-based information society, the Internet is a powerful tool for communication in the cyberspace. Research into Internet communities and online behavior constituted one of the earliest and most dynamic fields of interest in the new field of Internet studies. However, the ideal of the cyberspace has been failed by `cyber-bullying` which indicates posting derogatory messages about sensitive subjects on newsgroups and chat rooms to bait into responding. The purpose of the present study was to consider the `freedom of expression` in the cyberspace and the legal sanction and self-regulation against `cyber-bullying` with the netiquette education. Based upon a comprehensive literature review, three main topics were summarized as follows: (1) the expansion of the freedom of expression in the cyberspace, (2) the legal sanction against `cyber-bullying` with the Internet communication, and (3) `self-regulation` for improving communication culture with the Internet through netiquette education. As a consequence, the field has become both narrower and dominated by intractable problematics. Cyber-libertarians also advocate a free and unfettered cyberspace, unencumbered by regulation for the Internet communication. Despite this ideal view, laws around world are asserting their right to enforce individual regimes of content regulation. It is good policy that stimulating self-regulation organizations as an autonomous answerability system by the private sectors would be way not only to form socially reliable media also to reduce unnecessary legal/institutional regulation in the fact that active practice systems based on mutual cooperation among related key players are stressed in the Internet regulation system. Therefore, it is suggested that the private sectors need to make appropriate answerability measures as a self-regulation system with netiquette education-one of global trends-to minimize excessive legislative control by legal sanction.
