지방교육자치의 기본가치와 주요쟁점

국문 초록

그 동안 교육위원회가 형식상은 독립 형태를 유지하여왔는데, 2006년 개정된 `지방 교육 자치에 관한 법률`에서는 교육위원과 교육감을 주민직선으로 하되 시·도의회의 상임위원회(교육위원회)로 통합하기로 하였다. 그리고 2010년 개정 법률에서는 교육위원회의 설치 및 교육의원의 선거규정을 2014년 6월 30일 까지 효력을 갖는 것으로 규정하는 중대한 변화를 시도하고 있다. 본 논문에서는 첫째로 이러한 중대한 변화시점에서 지방교육자치의 기본가치가 무엇인가를 행정, 지방자치, 교육자치라는 세 측면에서 분석하고, 헌법재판소의 입장을 살펴보았다. 둘째, 핵심 쟁점인 교육위원회의 시·도의회의 통합조치가 교육자치의 기본가치 측면에서 문제가 없는지를 학계의 논쟁, 관련 헌법소원, 시범 운영을 하고 있는 제주특별자치도의 평가, 유사한 변화를 추구하고 있는 미국 워싱턴 디시의 평가를 통하여 살펴보았다. 한국은 그 동안 효율성이라는 가치만 강조하였지 인내와 포용이 필요한 민주성과 자주성 내지 자율성에 대하여서는 소홀하였기에, 교육 및 교육행정 분야에서 참여를 통한 자치경험이 강조되어야 함을 주장하였다. 그리고 지방교육자치제의 핵심 쟁점인 교육위원회의 지방의회에의 통합 내지 폐지는 지방교육자치제의 본질적 침해로 볼 수 있어 헌법상의 교육의 자주성·전문성·중립성 원리에 반할 수 있음을 지적하였다. 교육위원회의 지방의회에로의 통합이 수용되더라도 교육의원만으로 구성하고 실질적인 권한을 부여하여 지방자치와 교육자치가 조화를 이루어야함을 제의하였다.

영문 초록

The local educational assembly has been operated independently from the local general assembly in Korea. However, the Local Educational Autonomy Amendment Act of 2006 regulated the local educational assembly under the local general assembly as a committee composed together with the local assembly members. Moreover, the Local Educational Autonomy Amendment Act of 2010 regulates the local educational assembly is operated until June 30, 2014. The purpose of this study is to review the basic values of local educational autonomy, and to analyze whether the Local Educational Autonomy Amendment Act of 2006 and 2010 is constitutional in terms of basic and constitutional values. This study reviewed the basic values in three aspects; public administration, local autonomy, and educational autonomy. This study analyzed the issue of integration of the local educational assembly under the local general assembly in terms of scholar`s debates, relevant decision of the Constitutional Court, the evaluation of the Jeju Special Self-governing Province and the Washington District of Columbia operating as a model of integration. As a conclusion, this study emphasized the `autonomy` experiences through the participation of the citizens in the educational policy-making process because the efficiency value has been strongly stressed in Korea rather than autonomy or democracy value which requires more patience and tolerance. The hot issue of the local educational autonomy is the integration of the local educational assembly under the local general assembly as a committee and the abolishment of the local educational assembly in July 30, 2014. This study suggested the integration or abolishment of the local educational assembly could be unconstitutional because it would be a fundamental violation of the independence, professionalism, and political impartiality of education which is regulated in the Korean Constitution Article 31④.
