국문 초록

본 연구는 국가수준 학업성취도평가 결과의 공시와 관련된 법 조항 즉, 교육정보공개법 제5조가 국회의 논의 과정을 거치면서 법안에서와 달리 모호하게 기술되는 과정을 분석하였다. 교육정보공개법안 제5조는 국회에서의 법안 심사 과정을 거치면서 입장에 따라 달리 해석될 수 있는 중의적(衆意的) 내용으로 수정되었다. 법 조문의 모호성이 증가되고 위임입법 사항이 추가되는 과정은 법 조항에 대한 중의적 해석의 여지를 확장시키는 과정으로 볼 수 있다. 교육정책의 주요한 사항이 모호하게 진술되고 그 구체적인 사항의 결정이 행정부에 위임된다는 것은 교육정책의 잦은 변경 가능성이 확대된다는 것을 의미한다. 교육제도 법정주의의 원칙에 비추어 볼 때 이러한 현상은 보다 신중히 고려될 필요가 있다. 향후 교육정책의 결정 시스템에 관한 국가적 논의가 필요해 보인다.

영문 초록

This study is focusing on the change of article 5 in Act on Special Cases Concerning the Disclosure of Information by Education-Related Institutions (hereinafter the Education Information Posting Act : the EIPA). The Article 5 is related to posting of the results of the National Assessment of Educational Achievement. The result of this study shows that the article 5 was modified to ambiguous content through the screening process of the National Assembly. The result of modification which increase the ambiguity of the law and delegate of legislation can be seen as the process of expanding the room for different interpretations. Delegation of legislation to the government can cause frequent change of national education policy. That is why the delegated legislation should be carefully considered in the light of the principle of determination by act on the educational system. A prudent rethinking of national education policy making process is needed soon or later in the future.
