입학사정관의 역할과 임용에 관한 법적 검토

국문 초록

대입선진화정책으로 2008학년도에 도입된 입학사정관제도는 대입전형전문가인 입학 사정관이 성적과 다양한 전형자료를 활용하여 학생을 종합평가하는 대입제도다. 이에 입학사정관의 주요업무를 바탕으로 역할을 조사한 결과, 대입제도적 관점에서는 연구자, 평가자의 역할이 있고, 법규적 관점에서는 행정가, 조직적 관점에서는 홍보가, 상담가로서 고교와 대학을 매개하는 역할이 있었다. 이러한 역할은 도입당시와 5년이 지난 시점에서 약간 차이를 보였다. 도입초기에는 연구자와 평가자로서의 역할이 강조된 반면, 현재는 행정가, 홍보가, 상담가로서의 역할도 중요시되고 있음을 알 수 있었다. 또한 입학사정관 임용의 법적 근거가 되는 고등교육법은 입학사정관의 자격요건을 명확히 하지 않아 혼란을 주고 있으며, 퇴직 후 일정분야의 취업을 제한하여 헌법이 보장하는 직업선택의 자유 등을 침해할 소지가 있다. 취업제한 규정은 목적의 정당성은 지닌다고 할 수 있겠으나 과잉금지의 원칙 등을 위반하여 수정이 요구된다고 하겠다.

영문 초록

The admission officer system introduced in 2008 school year, based on the advanced university entrance policy, assesses by using grades and a variety student assessment data. An admission officer has a role of the researcher and the evaluator in institutional perspective, and he has a role of administrators in point of law, also he has a role of mediating high school and university as the publicist and the counselor in point of view organizational. These roles of an admission officer have the slight difference between the time of the introduction and after 5 years. It is highlighted a role of a researcher and evaluator in initially. Whereas now have a role of counselor and administrators, public relations. Also, The Higher Education Act as the legal basis of recruitment of an admission officer gives us confusion . Because it has not clarify the eligibility requirements for an admission officer. It rather limited employment in certain sectors after post-retirement. These limits have possibility to violate freedom of occupation and equal rights, guaranteed by the Constitution. They have the legitimacy of the purpose. but, these limits are required to be modified since they are contrary to the principle of excess prohibition.
