국문 초록

학교를 일괄적으로 배정함으로써 종립학교의 종교교육의 자유와 학생의 종교의 자유가 충돌하는 문제점을 우리나라는 안고 있다. 이 문제는 종립학교가 추구하는 종교교육의 자유와 학생이 추구하는 종교의 자유라는 두 기본권의 충돌로 대법원에까지 상고된 강의석 사건에서도 찾아 볼 수 있다. 미국을 중심으로 종교의 자유에 대한 의미와 법리를 이 연구에서 검토하고, 특히 공립과 사립학교에서 종교의 자유가 어떻게 문제시되는지를 전개한다. 이 연구는 여러 다양한 판례 분석을 통하여 미국 공립과 사립학교에서 일어나는 종교의 자유 관련한 판례나 판결이론이 분명히 구분 되는 것을 논의한다. 우리 나라와 달리 미국에서는 전반적인 학교선택권이 보장되기 때문에 공·사립학교의 특성이 더 드러난다. 나아가 이 연구를 통해서 우리나라의 종교교육의 자유와 관련해서 미국의 예를 참조 삼을 때 미국의 교육체계와 학교의 특성을 충분히 이해하고 접근해야 하는 점을 알 수 있다.

영문 초록

Religious Freedom is a guaranteed fundamental right. The scope and the conflicts surrounding the freedom of religion are presents itself as a legal issue in Korea. Similar to the fundamental right prescribed in the U.S., the Constitution of Korea also protects this right. First Amendment Bill of Rights prescribes the religious freedom by separation of church and state as well as freedom to exercise religion. This paper examines the religious freedom of students and schools within the school system. It`s central aim is to bring the issue of freedom of religion within the educational systems into further discussions. In doing so, the paper predominantly relies on the U.S. for its reference. Based on cases found in the U.S. legal system, the issue of freedom of religion that is guaranteed both in the United States and Korea is examined in greater depth. Since Korea`s school systems generally assign students to religious private schools regardless of their religious backgrounds, cases resulting in conflicts between students and private schools are easily found. By examining the Freedom of Religion clause in the U.S.`s First Amendment some light can be shed to the possible avenues to take in order to resolve the presented issue in Korea.
