국문 초록

이 논문은 역사적 전환점에 서있는 교육의원제도를 지방교육자치의 헌법정신과 지방 교육자치제도의 원리에 비추어 일몰제를 적용한 것이 규범적 타당성을 갖는 것인지 규명하고자 한 것이다. 동시에 2014년 7월부터 16개 시·도에서 도입한 ‘전원 일반의원형 교육위원회제’의 타당성에 대한 논의와 연계된다. 나아가 제주특별자치도의 ‘과반수 교육의원형 교육위원제’의 유지에 대한 향후 입법 정책적 제언을 위한 것이다. 연구 방법적으로는 교육의원 제도의 합헌성에 대한 이론과 판례를 분석하는 법해석적 접근과 동시에, 교육의원제의 실제 운영 성과 및 관계자 인식분석 결과를 활용한 법사회학적 접근을 병행하여, 이른바 교육법학적 논의를 시도하였다. 교육의원 일몰제 관련 헌법재판은 본안 심리없이 청구기간 도과로 각하되었지만, 그동안 헌법재판소가 지방자치단체의 기관 내부에서의 교육에 관한 의사결정과정을 어떻게할 것인지의 여부를 입법부 위임사항으로 보았다는 점에서 ‘교육의원 일몰제’ 폐지 자체를 위헌판결 할 가능성은 높지 않다. 다만, 그 결과 초래된 ‘전원 일반의원형’ 교육위원회제도는 헌법재판에서 확립된 이중자치론이나 민주주의·지방자치·교육자주라는 헌법적 가치 존중이라는 관점에서 헌법정신에 충실한 결과라고 보기 어렵다. 입법 정책적 과제로서 이원화된 교육위원회 운영방식을 통일할 과제를 지적했고, 이를 위해 16개 시·도 유형과 제주도 유형의 운영성과에 대한 실증적 비교분석를 통하여 향후 개선 준거로 삼을 것을 제언했다. 또한 금번의 일몰제 교육의원 사태에 대하여 책임있는 입법부, 정부, 학계가 수행하여야 할 과제에 대하여 제언하였다.

영문 초록

The purpose of this study is to review the norm validity of the Sun set system of Educational Members in local council(hereinafter referred to as ‘SEM’) and to suggest the direction of legislation policy in the revision of ‘Act on local educational autonomy’. The main characteristic of the approaching method of Education Law is to analyze a legal consciousness as well as reality of the law. Article composed of four chapters; introduction about problem situation and research framework, analysis about process of argument and criteria of judgement, diagnosis about the norm validity of SEM, and conclusion and tasks of legislative policy. The educational autonomy system is based on the Article31④(Independence, professionalism and political impartiality of education) and Article117,118(local autonomy) of Constitution. And it``s direct base comes from the Basic Act on Education(§5①). The Constitutional essence of the educational autonomy system is to equally guarantee the value of democracy, local autonomy, and independency of education. To maintain the educational member system is the main conclusion of bill of the Assembly. As a conclusion, this article suggested the some lessons through the case study of Constitutional Court and previous studies for the recognition of people related with educational member system. The renewal of the educational members in local council should be substituted for SEM to improve the norm validity. It was proved that the educational members in local council were more specialized and passionate than ordinary members through the preceding research analysis. Because only ordinary member system is not sufficient for Constitutional spirits(Dual Autonomy, Harmonious guarantee among Democracy, Local autonomy, and Educational independency).
