국문 초록

이 글은 학생인권조례의 제정·시행을 둘러싼 담론을 검토한다. 특히 학생인권의 당위성을 인정하면서도 학생인권조례의 제정·시행에 관해서는 의견을 달리하는 주장을검토한다. 이와 관련하여 학생인권조례에 반대하는 주장을 크게 세 가지로 구분하여 살펴본다. 이 세 가지를 필자는 역효과 명제, 무용 명제, 위험 명제라고 칭하고자 한다. 필자가 학생인권조례를 둘러싼 논쟁에서 이 세 가지를 주목하는 이유는 이 명제들이 학생인권조례의 쟁점을 분명하게 드러낸다고 여기기 때문이다. 조례 제정에 반대하는 주장의 근거는 학생인권조례가 오히려 학생인권을 침해하고 상위법령의 개정으로 유명무실하며 교육의 본질을 훼손한다는 것이다. 이를 필자가 제시하는 세 가지 명제로 치환함으로써 그 의미를 분명히 할 수 있을 것이다. 세 명제를 통해 학생인권조례의 주요 쟁점을 분석함으로써 학생인권조례 제정에 반대하는 주장에 대한 필자의 주장을 개진한다. 결론적으로 이 세 명제의 분석은 학생인권조례 논쟁 해결의 실마리를 제공할 것이다.

영문 초록

This study is to review the discourses on legislation and implementation of students` human rights ordinance. In particular, it focuses on the conflicting arguments on law-making and putting into practice of it even they recognize the necessity of students` human rights. It takes three oppositions into discussion. It calls them as perversity thesis, futility thesis, and jeopardy thesis. This pays attention to these three because these theses can obviously show the issues concerning the students` human rights ordinance. Opponents of law-making insist that the ordinance can infringe boys and girls` human rights, that it can be futile by the revision of upper law, and that it can damage the essence of education. Replacing these argumentations as three theses this can make the issues clearer. This comments on these opposing ideas by analysing the major issues using three theses. In conclusion, this review and analysis provides clues for conflicts solution about the legislation and implementation of students` human rights ordinance.
