국문 초록

이 연구의 목적은 교육정책 전반과 자유학기제ㆍ교육과정 등 핵심 교육정책에 대해 법정책학적으로 접근하여, 집권 2년차에 박근혜 정부 교육정책이 종합적 상호관계 속에서 효과적으로 수립 및 추진될 수 있는 대안을 도출하는 데에 있다. 주요한 연구 결과는 다음과 같다. 첫째, 박근혜 정부 교육정책의 기본방향은 ‘행복교육, 창의인재 육성’으로 요약되나, 이것이 지향하는 바가 무엇인지는 명확하지 않다. 그리고 2014년에 새롭게 추가된 과제 중 일부는 기본방향에 부합한다고 보기 어렵다. 둘째, 자유학기제를 전면 도입하기 위해서는 교육과정 전면 개편이 필요하고, 2016년 전면 도입을 목표로 추진하는 자유학기제 추진 일정은 늦출 필요가 있다. 셋째, 교육과정과 교과서 개편은 불가분의 관계에 있고, 자유학기제의 성공적 추진에도 큰 영향을 끼친다. 현재 추진 중인 교육과정 개편 및 교과서 개편 등 관련 일정을 늦추는 것이 타당하고, 핵심 교육정책간의 불일치를 해소하기 위한 방안을 마련해야 한다. 넷째, 교육과정 및 교과서 발행 개편에 관한 사항을 법률로 직접 규율하는 방식은 교육의 내재적 자율성을 훼손할 수 있으므로 신중해야 한다. 다만, ‘교육부의 독점적ㆍ폐쇄적 운영방식’과 정치적 압력 등이 학교에 여과 없이 전달되는 문제는 개선해야 한다. 다섯째, 초ㆍ중ㆍ고교 교육단계별 교육목적을 명확하게 규정하고, 그 목적에 따른 교육과정 및 평가제도 개편을 위한 기구를 설치하는 입법 방안을 추진할 필요가 있다.

영문 초록

The purpose of this study is to draw ways to establish and proceed the education policy of the second year of Park Geun-hye Administration effectively in comprehensive interrelations, by analyzing the education policy generally and the major education policy, such as free semester and curriculum, based on politics of law. Main study results are as follows: First, the basic direction of Park Geun-hye Administration is summarized as ``happiness education, creative outstanding individuals,`` however, what it pursues is inevident. Additionally, it is difficult for some of the newly added tasks in 2014 to meet the basic direction. Second, it is essential for the Administration to generally reform the curriculum, and to postpone the schedule of proceeding the free semester being introduced generally from 2016. Third, curriculum and textbook reform are inseparable relation, and they have great effects on successful process of free semester. It is reasonable to delay curriculum and textbook reform and to have plans to resolve discordance between education policies. Fourth, it is crucial for the Administration to be cautious in regulating curriculum and textbook establishment reform legally because it is possible to infringe internal autonomy of education. Moreover, the Administration needs to reform implication of exclusive operation of the Ministry of Education and of political pressure without filtration to schools. Fifth, it is necessary for the Administration to clarify the purpose of elementary and secondary education and to proceed legislative plans to establish organizations to reform curriculum and evaluating system.
