외국의 입체적 토지이용 관련 제도에 관한 소고

국문 초록

본 연구는 입체적 토지이용이 급증하는 현 상황에서, 외국의 입체적 토지이용 관련 제도를 조사ㆍ분석하고, 이를 평가해봄으로서 우리나라에게 주는 시사점을 모색하는 것이 목적이었다. 연구 결과, 무엇보다도 입체적 토지이용 관련 제도의 개선과 지금도 끊임없이 발생되는 각종 토지문제의 해결은 앞으로도 우리가 연구하여야 할 중요한 연구대상 및 과제가 된 것만은 틀림없는 사실이 되었다. 따라서 우리나라에서도 토지를 보다 효율적ㆍ입체적으로 이용하기 위해서는 첫째, 입체적 토지이용과 관련하여 미래지향적인 법제도가 마련되어야 할 것이다. 둘째, 지하공간과 공중공간을 효율적으로 이용하여 도시공간을 확대하고, 도시기능을 보완하는 지하 및 지상공간개발에 대한 다각적인 접근이 필요하다. 셋째, 공중권제도의 장점 도입이 필요하다. 넷째, 사전에 지하공간에 대한 합리적ㆍ체계적인 규 제의 틀이 마련되어야 할 것이다.

영문 초록

In the current situation where multi-dimensional land use is rapidly increasing, the purpose of this study was to research, analyze, and examine the systems related to multi-dimensional land use in overseas countries to understand what they suggest to Korea. As a result of the study, it was found that the improvements of the system related to multidimensional land use and the solutions to various land problems constantly occurring are the important object of study and assignment for us. Therefore, in order to use land more efficiently and dimensionally in Korea, first of all, future-oriented laws related to multi-dimensional land use must be established. Second, it is necessary to use underground and air space efficiently to enlarge urban space, and also to adopt multilateral approaches toward underground and air space for supplementing the city functionality. Third, it is necessary to adopt the advantages of air rights system. Fourth, it is required to prepare reasonable and systematic regulations for underground space in a proactive manner.
