국문 초록

건축협정은 단일필지로는 건축이 원만하지 못한 필지의 토지주 및 건축주들로 하여금 자율적인 주민협정을 체결하여 효율적인 건축을 하도록 유도하는 제도이다. 건축협정의 취지는 주거지역 및 상업지역에서 건축 관련 이해관계를 주민간의 합의에 의해 합리적으로 관리 할 수 있도록 하는 주민 주도의 도시 관리제도로 일본에서는 1950년대부터 활발히 추진되어 왔으며, 현재도 마찌쭈꾸리사업의 일환으로 건축협정을 유지시키면서 주민들이 자율적으로 자신들의 마을에 대한 애착심과 자긍심을 갖도록 유도하고 있다. 우리나라는 2004년 ｢건축법｣개정시 건축협정에 관한 부분을 포함하고자 하였으나 국회심의 과정에서 제외되었고, 2014년 ｢건축법｣개정시 건축협정에 관한 부분이 개정안에 포함되어 2014. 10. 14. 부터 시행하고 있다. 건축법상 건축협정이 시행된 후 건축협정 제도의 조기정착을 위하여 국가 시범사업으로 협정지역을 지정하여 실시하였으나 일부지역은 포기하는 사례가 발생하기도 하였다. 본 연구에서는 한국과 일본의 건축협정에 관한 법령과 실제 사례를 비교하여 개선방안을 제시하고자 한다.

영문 초록

The architectural agreement is a scheme that encourages parcel landowners and architects to construct efficient housing by concluding autonomous residents agreements. The purpose of the agreement has been actively promoted in Japan in the 1950s as a resident-driven urban management system that enables the management of building-related interests in residential and commercial areas to be managed reasonably by agreement among residents. Today, as part of the Machi-Tsukuri project, the city keeps the building agreement and encourages its citizens to have autonomy and attachment to their villages. In the case of Korea, the revision of the 2004 Architectural law was intended to include the part on the building agreement but it was excluded from the deliberation process of the National Assembly. As part of the amendment to the Architectural law of 2014, the amendments to the Architectural Agreement have been implemented since October 14, 2014. As a result of the implementation of the building agreement in the Architectural law, the agreement area was designated as a national pilot project in order to take effect for a short period of time. In this study, we compare the laws and practical cases of Korea and Japan s architectural agreements and suggest ways to improve them.
