해양공간계획의 법제화 현상과 개선과제

국문 초록

최근 해양은 운송, 항만, 어업 등 전통적인 활용영역을 넘어 연안도시 건설, 레저 활동, 신재생에너지 개발 등 해양공간의 이용이 다양화되고 있다. 해양은 표면, 수체, 해저를 각 다른 용도로 활용할 수 있다는 점에서 육지에 비해 다용도 지역이 더 많은 특징을 지니는데, 경제활동의 영역이 다방면에서 해양으로 확대되고 해양에 대한 관심과 수요가 증대되면서 해양공간에 대한 각 수요자의 선점식 이용에 따른 생태계 파괴와 난개발로 부작용과 갈등도 끊임없이 발생하였다. 과학기술 발전, 인구 증가로 해양 이용 및 개발이 증가하였으며 증가한 해양 이용으로 해양환경이 변화되고 과도한 이용은 해양생태계 부정적 영향을 미치게 되었다. 개별법에 의한 부문별 지구설정으로 해양공간 이용·개발시 이해가 상충되고 공간이용방 향과 해양환경 및 생태계 관리 연계성이 부족해졌다. 부처별 해양공간 선점 경쟁이 가속화되면서 이용과 보전간 혹은 이용간 갈등이 심화되었으며, 개발·이용과 해양생태계 보전간의 갈등을 적절하게 관리하고 해양을 공간적 관점에서 종합적으로 관리할 수 있는 수단의 필요성은 날로 커지게 되었다. 이에 미국, 영국 등 주요국들은 해양공간에서 나타나는 다양한 이용행위와 그로인한 문제를 종합적으로 관리하며, 해양의 지속가능한 이용·개발 및 보전을 도모하고 해양공 간을 통합관리하기 위한 해양공간계획(MSP: Marine Spatial Planning)에 주목하게 되었다. 우리나라도 해양공간의 체계적 관리에 관한 내용을 담은 해양공간계획 및관리에 관한 법률(2018.4.17. 법률 제15607호) (이하 ‘해양공간계획법’)이 2017년 제정되었다. 동법의 핵심 취지는 기존 해양공간의 선점식 이용에서 해양 공간의 특성과 생태계 가치를 반영한 선(先)계획 후(後)이용 방식을 도입해 우리나라 전 해역을 체계적·과학적으로 관리하기 위한 것이라 할 수 있다. 이에 본고에서는 해양공간계획의 법적 의의를 분석하고 해양공간계획에 관한 주요국의 사례, 해양공간계획법의 입법 배경과 취지를 살펴본다. 이를 토대로 해양공간계획법의 주요 개선 과제를 도출하고 바람직한 개선방향을 제언하고자 한다.

영문 초록

The oceans are more important than others—both from ecological, as well as economic, social and cultural perspectives. Effective and efficient marine spatial planning and management should address this spatial and temporal heterogeneity of marine spaces. Marine spatial planning (MSP) is a process of analyzing and allocating parts of three-dimensional marine spaces (or ecosystems) to specific uses or objectives, to achieve ecological, economic, and social objectives that are usually specified through a political process. The oceans have more features in the multipurpose area than in the land because they can be used for different purposes such as surface, water body, and seabed. As the area of economic activity extends from various fields to the oceans, and the interest and demand for the oceans grows, conflicts over the oceans are also increasing. In Korea, marine space planning law was enacted in 2017, which covers the systematic management of marine space. The main purpose of this law is to systematically and scientifically manage the entire oceans of Korea by introducing the after-planning method that reflects the characteristics of marine space and ecosystem values in preemptive use of existing marine spaces. MSP will contribute to the establishment of a system for systematic and comprehensive management through sustainable use of marine spaces. MSP will provide a theological basis for sustainable use of oceans by supplementing the management of homeland mainly focused on land and considering marine areas from a spatial perspective. This paper analyzes the legal significance of MSP and examines the case of major countries on MSP and the legislative background and purpose of MSP Act . Based on the results, we propose the major improvement tasks of MSP Act and suggest the desirable improvement directions.
