국문 초록

데이트 폭력은 일반적으로 형법상 범죄의 형태를 보이고 있으나, 가정폭력범죄와 같이 긴밀하고 특수한 관계인 연인관계에서 발생한다는 점에서 그 위험성이 매우 높다. 반면, 가정폭력범죄의 경우, 그 범위가 가족구성원으로 한정되어 있어, 연인관계를 포 섭하기 어렵다는 점에서 데이트 폭력을 가정폭력범죄에 적용할 수 없다는 난점을 안고 있다. 이러한 데이트 폭력은 간섭과 집착에서, 폭행·상해, 성범죄, 살인에 이르기까지 매우 광범위하고 진화하는 행태를 보인다. 또한 연인 사이에 서로 공유하는 정보가 많아, 형벌권이 발동된다 하여도 보복의 가능성도 매우 높다는 특성을 갖는다. 이로 인해 당사자 간에 발생하는 잔인한 사건 이외에 가족이나 피해자 주변인들에게까지 악영향을 주고 흉포해지는 현상을 보이는 것이 데이트 폭력의 현주소라고 할 수 있다. 미국의 경우에는 가정폭력범죄 처벌에 관한 법률의 개정을 통해 연인관계에 발생하는 범죄에 대하여 강력 대처하고 사전예방차원에서 일명 ‘케이티 법’을 시행하므로 데이트 폭력을 미연에 방지하고자 노력하고 있다. 일본에서도 데이트 폭력의 해결방안으로 단계별 위험정도에 따라 DV방지법과 스토커 규제법을 통해 처벌대상의 기준을 명시하고 있다. 우리 국회에서도 데이트 폭력에 대한 심각성을 인식하고 데이트 폭력범죄 처벌에 관한 법률안을 발의하였으나, 개별법이나 특별법의 남발을 이유로 현행법에 편승하자는 논의가 있어, 현재 계류 중에 있다. 데이트 폭력에 대응하기 위해서는 법적·사회적 인식의 변화가 필요하고 제재의 규정과 예방책이 마련되어야 한다. 따라서 당사자 범위의 기준, 당사자 간 위험의 정도에 따른 특성을 고려하여 독자적인 형사제재를 통해 가해자 처우와 피해자 보호가 함께 이루어져야 한다.

영문 초록

Dating violence is generally a form of crime on the Criminal Law. However, in the sense that it occurs in a romantic relationship which is close and special relationship such as domestic violence crime, the risk is very high. On the other hand, in the case of domestic violence crime, since the scope of the crime is limited to the family members, it is difficult to apply the dating violence to domestic violence crime. Such dating violence is very broad and evolving, from interference and obsession to assault, bodily harm, sexual crime, and murder. In addition, since there is a lot of information shared among lovers, the probability of retaliation is very high even if a penalty is exercised. As a result, in addition to the brutal incidents that occur between the parties, it gives bad effects to the family and the people of victim and it shows more and more ferocious. This can be said the current status of dating violence. In the case of the United States, through the amendment of the law on the punishment of domestic violence crime, it copes strongly with against crimes that occur in the romantic relationship. And as a precautionary measure, the so-called Katy law is being implemented to prevent dating violence. In Japan, as a solution to dating violence, according to the level of risk it is specified the criteria for punishment such as the DV prevention law and the stalker regulation law. Korean National Assembly also recognized the seriousness of dating violence and proposed the a bill on punishment of dating violence. However, there is discussion to be done by current law for the reason of individual law and special law enforcement, and is pending now. In order to cope with dating violence, the changes in legal and social awareness are required and the provisions of sanctions and precautions should be prepared. Therefore, considering the criteria of the scope of the parties and the characteristics of the degree of risk among the parties and through the independent criminal sanctions, treatment of the perpetrator and protection of the victim should be done together.
