국문 초록

유신헌법은 1970년대 한국이 처한 정치∙경제적 위기에 의해 촉발된 것이라기보다는 위기를 장기 집권의 기회로 활용한 박정희의 정치적 선택과 결단에 의해 제정된 것이었다. 이 글은 박정희의 권력 의지가 유신헌법에 구현되는 과정에 초점을 맞추어 다음과 같은 점을 강조하고자 한다. 첫째, 1970년대의 헌법학자들은 유신헌법을‘위기헌법’이라고 정당화했지만, 실 제로는 박정희의 권력 의지를 헌법에 구현하려 했던‘권력 개인화’의 결과였다. 둘째, 1970년대의 한국이 직면한 위기는 권력의 개인화를 시도했던 박정희에 의해 의도적으로 활용된 것이었다. 셋째, 박정희의 권력 의지를 반영한 유신헌법은 결국 대통령의 장기 집권과 무제한적 권력행사를 보장하는 극단적인 비대칭적 권력구조를 형성했다. 결국 박정희 정권의 비극적 종말은‘개인화된 권력’그 자체의 한계 때문이기도 했지만, 보다 근본적으로는 권력에 대한 어떠한 도전과 견제도 허용하지 않는 유신헌법의 제도적 특성에 기인한 것이다.

영문 초록

The sudden advent of Yushin Regime in 1970’s Korea was not stimulated by political and economic crisis itself but resulted from Park Chung Hee’s political resolution of long term seizure of power. This study, focusing on the constitutional realization process of Park’s will to power, stress three points as follows. Firstly, although most students of Korean constitution in 1970’s legitimized Yushin constitution as ‘crisis constitution’, it was the outcome of ‘personalization of power’ which embodied the Park’s will to power to constitution. Secondly, the crisis that Korea faced in 1970’s was intentionally utilized to personalize the power of Park. Thirdly, Yushin constitution that reflected the Park’s will to power constituted an asymmetrical power structure that guaranteed Park’s long term seizure of power and unlimited exercise of power. Eventually the tragic end of Park’s regime was partly due to the limits of personalized power itself, but more fundamentally it was the result of institutional traits of Yushin constitution that did not permit any challenges and restrains against power.
