국문 초록

최근 국내에서 증가하는 외국인의 수는 외국인에 행해지는 범죄문제의 증가현상으로 이어지고 있다. 이에 국내 교정시설에의 외국인수용자 진입이 늘어나고 있으며, 외국인수용자의 신분과 지위의 특수성을 고려한 특별한 처우가 필요하다. 국제사회에서도 외국인수용자의 보편적 권리존중을 위한 수많은 국제규약이 권고되고 있으며, 국가마다 또 다른 사회갈등 방지를 위한 교정기관의 다양한 복지정책들이 시행되고 있다. 국내에서도 외국인에 의한 각종 강력범죄 사건이 발생하고 있지만, 범죄의 심성제거와 재범방지라는 교정기관의 궁극적인 목적 달성을 위한 다양한 정책과 프로그램들이 시행되고 있다. 이와 관련하여 외국인범죄자를 위한 교정정책은 수용처리에 따른 막대한 국가비용 소모문제, 상대국과의 민감한 외교문제로 비화될 가능성 상존, 국제사회에서의 국가 이미지와 신인도 실추 등의 문제가 발생할 여지가 있기 때문에 외국인 수용자의 처우문제에 있어서는 내국인수용자와 동일하게 각별한 주의와 노력이 필요하다.

영문 초록

Recently, the number of foreigners who are increasing in Korea has been increasing as a problem of crimes committed by foreigners. Therefore, entry of foreigners into correctional facilities in the country is increasing, and special treatment is needed considering the specificity of status and status of foreign prisoners. In the international community, a number of international protocols are being recommended for respecting the universal rights of prisoners of foreigners, and various welfare policies are being implemented by different regulatory agencies in different countries. Although there are various types of violent crimes by foreigners in Korea, various correctional policies and programs are being implemented to achieve the purpose of the correctional institutions such as elimination of criminality and prevention of recidivism. As a result, In the case of the treatment of foreigners, it is necessary to pay special attention and effort to them because of the correctional policy for foreign criminals may be problematic due to huge expenditure of national expenses, the possibility of being disturbed by sensitive diplomatic issues with the other country, the national image in the international society,
