아동학대범죄의 처벌 등에 관한 특례법의 주요내용 및 개정방향

국문 초록

아동학대의 예방을 위한 사회적 합의를 그 내용으로 하는 아동학대범죄처벌법은 그 시행과 함께 보호자에 의한 아동학대에 대한 사회적 인식의 변화를 가져왔으나, 동법의 실효성과 입법방식과 관련해서는 비판적 주장들이 끊임없이 제기되어 왔다. 이를 위해 동법은 2016년과 2017년 일부 개정을 거친 바 있으나, 일부 입법상 미비점을 보완하는 방향에서 이루어진 단편적 개정에 그쳐 종전의 비판을 종식시키지는 못하고 있다. 이에 본 논문은 동법의 구체적인 내용과 관련하여 개정을 통해 정비된 내용과 개정후에도 여전히 남아 있는 문제점을 지적하고 동법의 실효성을 담보하기 위하여 향후 이루어질 개정 방향을 제시하고자 한다. 이를 위해 아동학대범죄의 개념의 명확화, 가중처벌조항들의 합리적인 관점에서의 조정, 긴급임시조치와 임시조치의 개선방향, 피해자보호명령제도의 개정방안을 서술하였다. 그러나 아동학대방지방안의 실효성을 담보하기 위해서는 이러한 법률의 개정만으로는 부족하고 학대행위자에 대한 교정 및 치료프로그램의 확대, 아동보호기관의 증설과 전문인력의 확충, 관련부처와 유관기관들의 적극적인 협력체제 및 관련 인프라 구축이 동시에 추진되어야 가능하게 될 것이다.

영문 초록

Child abuse crime punishment law, which includes social agreements for the precention of child abuse, has brought about social changes in awareness of child abuse by guardians; however, critical claims have been constantly raised regarding the effectiveness of the Act and the legislative method. Although the Act has been partially revised in 2016 and 2017, it has been partially revised in the direction of complementing the weakness in some legislation, and it does not end the previous criticism. In this paper, it was pointed out the problems that remain after the amendment and the revised contents of the Act, and propose the future revisions to guarantee theeffectiveness of the Act. To make this Act effectivelty, it is described that clarification of the concept of child abuse crimes, adjustment from a reasonable point of view of the heavy penalties provisions, direction of improvement of the temporary measures and the emergency temporary interim measures, and revision of victim protection order system. However in order to guarantee the effectiveness of the measures to prevent child abuse, it is not enough to revise these laws. It is necessary to expand the correction and treatment programs for the abusers, to expand the child protection institutions and to expand the professional manpower. It will be possible to build related infrastructures at the same time.
