서체파일의 저작권 쟁점에 관한 연구검토

국문 초록

글자를 바탕으로 한 작품은 창작성 등의 요건을 갖춘 경우 서예 작품 또는 캘리그래피로서 미술저작물의 일종으로 보호가능하다. 하지만 한 벌의 글꼴인 서체 ‘도안’은 저작권법의 보호대상이 되지 않으며, 다만 서체 ‘파일’은 컴퓨터프로그램저작물로서 보호가능하다는 것이 대법원의 입장이다. 이와 같은 대법원의 견해는 그 자체로도 문제가 있을 뿐만 아니라 서체(파일)의 저작권자, 저작권의 보호범위와 침해 판단 등 저작권의 다른 쟁점들에까지 혼란을 주고 있다. 이러한 혼란은 서체파일의 분쟁에 관한 하급심 판결에까지 영향을 미치고 있다. 이와 같은 상황에서 서체파일을 둘러싼 저작권 판례이론은 재정리될 필요가 있다. 인쇄를 전제로 하지 않는 서체의 경우 현행 저작권법상 응용미술저작물의 독자성 요건은 충족시키는 것으로 보이므로, 문자의 기능적 측면을 고려한 창작성 관점에서 서체의 저작물성을 판단할 필요가 있다. 창작성이 인정되는 독특한 서체의 저작물성을 인정하는 경우 그 서체의 저작자는 서체도안을 디자인한 자이거나 그의 사용자로 볼 수 있다. 서체도안이 저작권법에 의해 보호를 받게 되더라도 그 보호범위는 문자로서의 기능적 부분에는 미치지 않으며, 서체의 독특한 디자인 부분만 보호를 받게 된다. 나아가 서체파일을 이용하여 작성한 결과물에 대해서는 판례 또는 입법을 통하여 서체의 저작권이 미치지 않도록 일정한 제한이 필요하다고 본다.

영문 초록

Works based on letters are protected as art works if they meet the copyright requirements. However, the Supreme Court’s position is that the font design is not protected by the Copyright Act, but the font ‘file’ can be protected as a computer program work. This view of the Supreme Court is not only a problem in itself, but also influences the copyright ownership of the font file, the scope of copyright protection, and other issues of copyright. As a result, some problems are revealed in follow-up rulings on the dispute of the font file. In such a situation, the copyright case theory surrounding the font file needs to be reorganized. In the case of non-printing font design, the requirements of applied art works are satisfied in accordance with current copyright laws. Therefore, it is necessary to judge the copyright subject matter of the font design in terms of creativity considering the functional aspects of the characters. In the case of recognizing the subject matter of font design, the copyright owner the font design is the person who designed the font design. Even if the font design is protected by the copyright, the scope of protection does not extend to the functional part as a letter, and only the unique design portion of the font is protected. Furthermore, certain limitations are required for the result created by using the font file so that the copyright of the font is not violated.
