국문 초록

근래 데이터 소유권의 도입 또는 인정이 논의되고 있다. 그러나 그 논의의 기초가 되는 데이터 소유권의 개념은 전혀 분명하지 아니하다. 데이터 소유권이라고 부르는 것에 여러 차원의 논의가 뒤섞여 있으나, 그 고유한 대상은 구문론적 정보로서 데이터에 대한 배타적 재산권이고, 원칙적으로는 개인정보가 아닌 경우를 가리킨다. 현행법상으로도 이미 데이터에 대한 배타적 이익이 보호받고 있는 경우가 상당하나, 어떤 데이터가 사실상 배타적으로 관리되고 있는 경우에는 그 관리자에게 배타적 재산권을 부여함으로써 보호의 흠을 제거하고 더욱 완전한 보호를 꾀함과 동시에 일정한 경제적 효율의 개선을 기대할 수 있다. 그러나 그로 인한 효율의 개선은 - 기술발전의 필요성과 그 기여에 비하여 - 한계적(marginal)인 반면, 데이터 소유권을 정면에서 인정하여야 한다는 논의가 가져올 정치적, 이념적 갈등은 매우 근본적이다. 때문에 데이터 소유권 논의가 쉽사리 결실을 보기는 어려울 것이다.

영문 초록

People say that data is the oil of the so-called 4 th industrial revolution. Many industries are based on data. B2B data trades are considerably increasing. In this context, some scholars and policy makers argue that we should introduce or acknowledge a new proprietary right on data, i.e. a data ownership in order to enhance the efficiency of data economy. This argument, however, seems to overlook the concept of ownership, which is a technical term in law, and misunderstand the expected contribution and the limit of introducing data ownership. In this regard, I would contribute to the debate by clarifying the concept of data ownership and its limit. First, it would be demonstrated that the concept of data ownership means nothing but an exclusionary legal apportionment of the patrimonial use of syntactic information. And then, it would be shown that the difference that introducing data ownership would expect is either marginal or too revolutionary. In either case, it also might incur a profound debate on the new regime or social compromise for data society and at the same time might devastate the rising data economy.
