국문 초록

미술시장을 투명하게 하고 활성화시키는 것은 현재 우리나라 미술시장의 시대적 과제 이다. 우리나라는 미술시장의 오랜 침체를 극복하고자 정부와 미술관계자들이 다양한 노력을 해오고 있다. 현재 미술품의 관리와 관련하여서는 저당권 등록, 한국 미술시장 정보 시스템에서 경매 이력 등록, 담보권 설정, 앞으로 시행될 거래이력 보관 등이 그것이다. 하지만 이들 제도는 산만하게 흩어져 있어서 미술작가나 소비자 입장에서 미술품에 관한 권리관계를 쉽게 파악하거나 관리하기 어렵다. 즉 시장에서 가장 중요한 공급과 수요의 주축이 되는 미술작가와 소비자에게 있어 복잡하고 불투명한 제도는 미술시장의 활성화를 방해하는 중요한 원인이 된다. 그리고 미술시장에서 제기되고 있는 위작의 문제나 가격의 불투명성에 대한 문제 그리고 미술작가의 열약한 지위에 관한 문제들은 독립적이지 않고 상호 연계되어 있기 때문에 어느 하나의 문제 해결을 위한 지엽적 해결방안으로는그 실효성을 거두기가 어렵다. 또한 동산의 특성상 문제가 될 수 있는 점유에 대한 공신력 인정으로 인한 진정한 소유권자 보호를 위한 문제 그리고 위작을 판단하기 위한 기준 마련을 위한 문제해결이라는 측면에서도 현재까지의 제도는 이러한 모든 문제를 포섭하여 통일적이고 체계적으로 해결하는 데는 한계가 있다. 이러한 모든 문제를 포섭하여 해결할 수 있는 방안으로 미술품 등록제 도입을 주장하며, 미술품 등록제의 도입 방향과 도입시 내용과 절차 그리고 법적 효력에 대해서 살펴보았다. 미술품 등록제는 미술품 소유 권에 대한 강한 추정력을 부여하게 되어 관련된 각 종 제도들을 실효성 있게 하는데 매우 중요한 기초가 될 수 있을 것이다.

영문 초록

Making and vitalizing the transparent art market are the task of the ages in our art market. As the public attention is focusing on the art market due to the forgery cases of the works of Cheon Gyeong-Ja and Lee Woo-Hwan and to recent vicarious work of Cho Yong-Nam, the claim of making and vitalizing the transparent art market is gaining the strength. The cartel in the market is considered as the cause that the art market is remaining in the recession. The monopoly in the art market generates various side effects but it does not seem to be solved easily. In this situation, to vitalize the art market, the indirect measures should be discussed. The most important requirement to vitalize the art market is to create lots of good art works and to secure the sufficient consumer class. Therefore, if the artist can maintain the stable position by securing the position so that he/she can secure initiative for their works making good art works, it will be a foundation to vitalize the art market. To do that, the pricing of art works should be transparent, the transaction history should be disclosed, the overtaking right should be introduced and the art work security system should be utilized actively. Since the art work registration system can solve the problems all at once by integrating such solutions, it can maximize the effectiveness. In addition, it is expected that the certain part of the forgery problem also can be solved through the art work registration system. Introducing the art work registration system and building the art work registration system so that the art works created are registered before they are put in the market, and subsequent transaction details and relationships of right are written are suggested.
