국문 초록

한국에서 ‘4차 산업혁명’에 대한 관심이 지나친 것이라는 우려가 없지 않다. 하지 만, 한국이 비교우위를 가진 정보통신기술이 제조업과 고도로 융합하는 4차 산업혁명은 큰 기회가 될 수 있으므로 한국사회전체가 곧 도래할 4차 산업혁명 시대에 대비할 필요성이 있다. 아울러 지적재산권 차원에서도 일정부분 대비가 필요하다. 4차 산업혁명을 구현하기 위한 기술들로는, 가장 중요하다고 보이는 ‘인공지능 기술’, 인공지능 고도화를 돕는 ‘빅 데이터 기술’, 인공지능 연산처리의 물리적 장소 및빅 데이터 저장공간으로 기능하는 ‘클라우드 컴퓨팅 기술’, 빅 데이터 집합정보의 원천을 제공하는 ‘사물인터넷 기술’이 있다. 그런데 자율주행자동차⋅로봇⋅드론과 같이 우리주변에 직접 위치한 개별기기들은 사물인터넷 기술의 적용대상에 해당하지만 그와 동시에 앞서 제시한 인공지능 기술에 의한 제어를 받게 된다. 결국 이 글의 이부분 고찰을 통해서보면, 앞에서 열거한 4차 산업혁명 관련기술들은 서로 순환적인 관련성을 가진 것으로 이해할 수 있다. 나아가 이 글에서는 4차 산업혁명 관련한 지적재산권 쟁점 등을 통합적으로 분석하 였다. 가장 먼저, 위 순환적 관련성으로부터 동떨어져 있는 ‘3D 프린팅 기술’은 시급한 고찰대상의 대상에 포함되지 아니함을 확인하였다. 다음으로 빅 데이터 기술 및클라우드 컴퓨팅 기술 등과 관련된 지적재산권 쟁점들을 두루 살핀 이유는, 이들 쟁점들의 해결이 궁극적으로 인공지능 기술의 발전을 뒷받침하는 것이기 때문이다. 나아가 인공지능 기술 자체에 관한 법적 쟁점들 중 인공지능에게 법인격⋅행위주체성 등을 인정할지 여부 문제는 우리 지적재산권법뿐만 아니라 법률 전체에서 통일적으로 매듭지어야 할 문제라는 점을 지적하였다. 또한 비록 지적재산권법 쟁점은 아닐지 라도 4차 산업혁명에 온당하게 대비하는데 아주 긴밀한 관련쟁점들로서 공정거래법 차원 등의 대비문제, 그리고 일응 너무 지나치다고 보이는 개인정보보호의 완화 필요 성이 가진 중요성을 필자의 시각에서 강조하였다. 덧붙여, 이상과 같은 여러 가지 분석내용을 이 글의 ‘결론’에서 일목요연하게 정리하고자 하였다.

영문 초록

There has been arguably some problem from the phenomenon that two much interest or concern had been shown in Korea for the so-called ‘Fourth Industrial Revolution. However, the Korean society as a whole needs to prepare for the upcoming fourth industrial revolution age, because the fourth industrial revolution in which the information and communication technology (ICT) would deeply combine with manufacturing industry can be a great opportunity for Korea that has already comparative advantage in ICT. In addition, in perspective of intellectual property of Korea, some appropriate preparation is also needed. The technologies for realizing the fourth industrial revolution include AI (artificial intelligence) technology which seems to be the most important, Big Data technology which supports advancement and acceleration of artificial intelligence, cloud computing technology which functions as a physical tool of calculation process by artificial intelligence and a storage for big data, and IoT (Internet of things) that provides source of individual informations which will finally compose the big data. Meanwhile, each individual things or products such as autonomous vehicles, robots and drone, which are located directly in our daily life, are the objects of IoT technology, but at the same time, they are subject to control by the AI technology presented above. As a result in this part’s analysis of this article, it is understood that the above technologies related to the Fourth Industrial Revolution have a kind of cyclical relationship with each other. Moreover, this article analyzed the whole issues of intellectual property rights related to the fourth industrial revolution by integrated approach. First of all, it is confirmed that 3D printing technology which is founded as actually distant from the above cyclical relation could not a core part of urgent consideration. Next, this article look at some intellectual property issues related to big data technology and cloud computing technology because the proper solution of these issues ultimately guarantees the smooth development of artificial intelligence technology. And among the legal issues concerning the artificial intelligence technology itself, this article especially points out that the issue of whether legal personality or eligibility as an agency for artificial intelligence itself should be acknowledged or not is the very problem to be solved in perspective of not the intellectual property law but the entire legal system uniformly in Korea. Also, although those are not the intellectual property law issue, this article emphasizes from the author’s point of view that the issue of another preparation in area of anti-trust law and etc. and the need to mitigate seemingly excessive privacy protection in Korea are important because those are a very close related issue appropriate preparation for the Fourth Industrial Revolution. In addition, this article tried to clearly summarize the above analysis contents in the conclusion part as far as possible.
