영국과 한국의 도로교통법령 특성 비교 연구

국문 초록

영국과 한국은 상호 다른 법체계를 가지고 있다. 이러한 법체계는 도로교통에 관한 법인 도로교통법령에서도 나타나고 있다. 영국은 도로교통에 관한 법령으로 「도로교통법(Road Traffic Act)」과 「간선도로법령(The Highway Code)」을 대표적으로 볼 수 있다. 한국의 도로교통법령은 「도로교통법」과 시행령을 두고 있다. 영국과 한국의 도로교통법령은 상호 각자 독특한 형태를 가지고 있으며, 특히 영국의 도로교통법령은 우리와 달리 구체성을 가지고 있는 특성을 가지고 있다. 영국 도로교통법령은 불문법으로서 법령을 개정할 경우 별도의 법령으로 수정·증보를 하고 있다. 이와 달리 한국 법령은 개정되는 경우 기존 법령안에 개정 또는 삭제라는 표시로 표기를 하고 있는 것과 다른 형태를 보이고 있다. 또한 내용적인 특성에서도 영국의 경우는 법령 규정이 주로 강행규정으로 “MUST/MUST NOT”, “should/should not”, “do/do not”이라는 표현을 사용하고 있으나, 한국 도로교통법령은 “…하여야 한다” 또는 “…할 수 있다”라고 하여 기속행위에 관한 강행규정과 재량규정을 동시에 사용하고 있다. 이처럼 영국과 한국의 도로교통법령은 상호 다른 특색을 가지고 있어 영국 도로교통법령을 한국과 상호비교하면서 향후 우리 도로교통법령의 개선방안에 지침이 될 수 있다.

영문 초록

Korea and the United Kingdom have its own different law system. The difference is seen in Road Traffic Ordinance and Road Traffic Law of the both countries. For example, The U.K has Road Traffic Act and The Highway Code which represents Ordinance of Road Traffic. On the other hand, Ordinance of Road Traffic in Korea has Road Traffic Act and its Road Traffic Ordinance. Also, each Road Traffic Ordinance of Korea and the U.K has its unique type individually. Road Traffic Ordinance of the United Kingdom, especially, characterizes its specification unlike that of Korea. In addition, when Road Traffic Ordinance of the U.K, as common law, is amended, it should be supplemented after being amended as a separate Ordinance. However, in Korea, existing Ordinance should indicate that it is amended or it is removed . Thus, it shows the difference between each Road Traffic Ordinance of the two countries. Moreover, there is also dissimilarity in contents of individual Ordinance of Korea and the U.K. For instance, Regulations of Ordinance of the U.K stipulate in a forceful way by using the following verbs: must/must not, should/should not, or do/do not. Conversely, they state with the following verbs: must/must not, can/can not, or may/may not. It reveals that Regulations of Ordinance in Korea are simultaneously compelling and allows some discretion. In conclusion, each Road Traffic Ordinance of Korea and the U.K.has dissimilar features respectively. Therefore, comparing Road Traffic Ordinance of Korea with that Of The U.K can be a guideline in improving Road Traffic Ordinance of Korea in the future.
