국문 초록

유럽은 다양한 경로로 여러 민족의 정착과 그로 인한 문화의 다양성 증가로 인한 문화적 갈등상태를 경험하고 있다. 문화적 갈등 중에서도 종교적 가치체계의 충돌은 심각한 사회문제를 야기하고 있는데 이는 결국 정착국의 법질서와 충돌을 야기하기도 한다. 이러한 문제의 해결을 위해서는 먼저 법과 문화의 상호관계에 대한 연구가 선행되어야 한다. 이러한 연구를 진행함에 있어 다양한 문화가 공존하는 유럽의 사례는 매우 중요한 시사점을 제공해 준다. 문화(종교)적 규범과 국가 실정법질서와의 조화가 중요한데 어떻게 조화를 이룰 수 있는지 그리고 어떻게 조화를 이루어야만 하는지는 유럽인권규약, 유럽인권재판소판례, 영국의 MAT를 통해 대강 가늠해 볼 수 있다. 다문화 사회에서 다른 세계관과 문화적 가치를 법적으로 수용하는 것은 매우 정교한 법이론적 준비가 필요하다. 더군다나 갈등을 해결할 일반적 법적 판단의 기준(예를 들면 비례원칙의 심사기준으로서 문화적 가치의 수용 정도와 그 한계)을 정립하는 것은 다문화 사회에서의 사회통합을 이루기 위해 법학계에 요구되는 시대적 과제이다.

영문 초록

Europe is experiencing cultural conflicts due to the settling of different ethnicities and the resulting increase in cultural diversity. Among the cultural conflicts, the clash of the religious perspectives causes serious social problems which eventually lead to clashes with the laws of the settlement country. In order to solve these problems, research on the relationship between law and culture should be preceded. In this study, the case of Europe where various cultures coexist provides very important implications. It is important to harmonize between the cultural (religious) norm and the national legal system. How harmonization can be achieved and how it should be harmonized can be gauged through the European Convention on Human Rights, Cases of the European Court of Human Rights and the Muslim Arbitration Tribunal in United Kingdom. In multi-cultural society, accepting other worldviews and cultural values into the national legal system of a different nature requires very detailed preparation with the legal theory. Furthermore, establishing the standard as a general legal theory (for example, the degree of acceptance of cultural value as the criterion of the principle of proportionality -Verhältnismäßigkeitsprinzip- and its limit) to resolve this kinds of conflict is a contemporary task to achieve social integration in a multi-cultural society.
