국문 초록

『韓非子』 「解老」에서 道는 만물의 보편법칙이자 존재 근거다. 理는 각 사물이 지닌 구체적 속성으로, 사물들을 서로 구별 짓는 기능을 한다. 理는 사물과 결합된 채 존재하므로 구체적 사물의 변화에 따라 변화하며, 절대적 독립성을 구가하지 않는다. 道는 이런 理가 모여 합쳐진 것이다. 理가 사물과 떨어져 독립적으로 존재하는 것이 아니듯, 道 역시 理와 떨어져 독립적으로 존재하지 않는다. 道는 理와 상응하여 사물에 내재하고, 사물과 관계 맺으며, 사물과 운명을 같이 한다. 道의 인식은 理의 파악을 통해 가능하다. 理로 전화된 道는 때와 더불어 변하고, 영원불변한 초월적 존재가 아니기에 말로 표현할 수 있다. 이는 전적으로 ‘理’라는 교량 개념의 등장에 힘입은 것이었고, 덕분에 세계와 역사의 운행 법칙을 설명하기도 한층 편해졌다. 理의 分別性은 군신 관계 정립에, 道의 可變性은 역사 발전론과 變法論에, 道의 法則性은 法治의 확립에 각각 철학적 근거를 제공한다.

영문 초록

In the chapter of Jie Lao (Interpretation of Laoz) in Han Feizi, dao is a universal law and the foundation of existence for all things. Li is a concrete attribute which each thing possesses and plays a role in making things unique from one another. Li exists as it is connected with things, so it can change as concrete things change and doesn’t have an absolute independence. Dao is the aggregation of this li. Dao doesn’t exist independently disconnected from li in the same way li doesn’t exist independently disconnected from things. Dao exists in things while corresponding with li, establishes a relationship with things, and shares its destiny with things. The perception of dao can be made possible by perfectly understanding li. Dao, which has already changed into li, changes along with li and can be verbally expressed since it is not an immortal and transcendent being. The perception of dao was entirely attributable to the appearance of ‘li’ as a medium concept, which made it much easier to explain the operation law of the world and history.· The differentiation of li provides a philosophical foundation for the relationship between king and subjects, as the changeability of dao does for the theory of history development and the theory of law change and as the nature of the law of dao does for the establishment of the rule of law.
