우주자산의정서에 관한 고찰

국문 초록

문명은 사람이 왕래하는 도시를 중심으로 발달하였다. 다양한 사람들이 모이고 다른 문화와 교류를 하는 것으로 부터 새로운 사회가 태어나고 그리고 역사를 개척해 나갔다. 우주법의 분야에 비즈니스와의 접점을 찾았다는 의미에서 케이프타운조약 의 우주자산의정서는 우주이용의 상업화에 있어서 상당한 의미가 있을 것이라 생각된다. 그것은 비록 직접적으로는 자산담보금융이라는 특정의 문제에 대한 제도를 준비하는 것에 지나지 않지만 우주와 관련된 금융수단의 확립은 본격적인 사업활동의 전제조건이기 때문에, 우주이용의 상업화에 있어서 중요한 인프라 구축인 것에 의심의 여지가 없다. 더구나 민사법에 관한 전문적인 국제기관으로 있는 사법통일국제협회(UNIDROIT)가 작성하고 각국의 비즈니스가 관여하고 있다는 점에서도, 지금까지는 오직 공법적 관점에서 논해져 왔던 우주법의 발전에서 획기적인 의의를 가진다고 볼 수 있기 때문이기도 하다. 케이프타운조약은 효율적인 자산담보금융을 위한 제도를 사법통일조약의 형태에서 정한 것이다. 이것은 광의의 담보 ① 담보계약에 의해 설정되는 담보적 이익 ②소유권유보부매매에 의해 매도인측이 유보한 소유권 ③ 리스계약에 의거하는 권리 에 관한 각국의 현행법의 개선을 제안하는 것과 동시에 체약국의 국내법을 통일하고 복수국의 당사자가 관여한 거래를 용이하게 한다는 이중적인 목적을 가진다. 이 조약에는 통칙을 규정하는 본체조약과 대상자산 마다 고유의 규정을 정하는 각의정서로 되어 있지만 이 중 본체조약 및 항공기의정서는 이미 2001년의 외교회의에서 채택되었고 우주자산의정서의 작성은 이것보다 약간 늦어지고 있고, 워킹그룹 에 의한 초안의 작성을 끝낸 2003년 12월의 제1회 정부간 전문가회합이 이뤄졌다. 그후 수차례의 전문가회의를 거친 우주자산의정서는 어쩌면 2012년 2월 27일부터 3월 9일 사이에 독일 베를린에서 개최될 예정인 외교회의에서 채택되어 질 전망이다.

영문 초록

The Protocol on Matters Specific to Space Assets differs in several aspects from the other Protocols. It deals to a large extent with ‘assets’ that are permanently out of reach. Seizure of rights and/or control by a creditor could cause friction with respect to state sovereignty. Furthermore, although thus far no conflict with existing international space law has been identified, the application of the Protocol could have consequences for the obligation of the launching state to retain jurisdiction and control, as well as for the international liability of the launching state. It is suggested that both matters can and should be resolved through national space legislation. Finally, the proposed Supervisory Authority is not an intergovernmental organization, but a subsidiary organ of the General Assembly of thc United Nations. At the third session of the Committee of governmental experts, held in Rome from 7 to 11 December 2009, it was agreed that future work should be based on the alternative text (technical amendments) which we had presented to the Committee of governmental experts. Various decisions were taken by the Committee of governmental experts affecting the drafting of the text, and the Drafting Committee was authorised to undertake inter-sessional work to reflect those decisions and to make other drafting improvements. The Drafting Committee appointed at the third session consisted of Canada, the People’s Republic of China, France, Nigeria, the Russian Federation, Senegal, the United Kingdom and the United States of America. In addition, Ms M. Leimbach participated in all meetings of the Drafting Committee, as an adviser on behalf of the international commercial space, financial and insurance communities.
