미국 불법체류자 단속권을 둘러싼 연방과 주의 법적 분쟁

국문 초록

본 연구는 미국 역사상 가장 엄격한 이민법으로 알려진 애리조나(Arizona) 이민단속법(S.B 1070)의 내용과 이에 대한 소송상 쟁점을 소개함으로서 이민정책의 방향을 결정하는 국가의 일부로서 법의 작동을 설명하는 것을 목적으로 한다. 불 법체류자 수가 급증하면서 국경 부근의 주 정부가 부담하는 비용도 증가하고 있어 신속한 대책이 요구되는 상황에서, 2007년 연방정부의 이민개혁법통과는 실패로 돌아갔다. 애리조나 주는 주 정부 차원에서 불법체류자의 단속문제를 해결할 목적으로 이민단속법을 제정하였다. 이 법안은 주 정부의 법집행기관으로 하여금 이민법적 지위의 확인을 의무화하고 불법체류자에 대한 영장없는 체포를 허용하였으며, 불법체류자 및 불법체류를 독려하는 행위 즉, 외국인등록의무의 회피, 불 법체류자의 취업 등을 형사처벌한다. 연방법은 주 정부에게 일정한 이민지위에 대한 질의권 및 연방정부와 합의조건부 집행권을 허용하는데, 애리조나 이민단속법이 이러한 연방법과 충돌하는 것인지 연방정부가 소를 제기함으로서 법원에서 다투어졌다. 애리조나 지방법원 및 제9항소법원은 애리조나 이민단속법이 연방의회의 의도와 충돌하며 따라서 연방법우선원칙에 반한다고 밝혔고 현재는 연방대법원에 계류중이다.

영문 초록

This thesis aims to introduce ‘Senate Bill 1070’ of Arizona state which is notorious for the strictest immigration enforcement law that any state in the United States has ever implemented. While illegal immigrants are becoming increasingly burdensome to states near the border demanding prompt responses, the federal government has to consider other states that need the labor of illegal immigrants as well as the lack of the resources and budget for enforcement. To solve this dilemma, the state of Arizona enacted the state law, Senate Bill 1070. According to this bill, local law enforcement officers have to confirm the immigration status of unauthorized immigrants with reasonable suspicion of illegal presence for legal stop, and all arrestees before release. In addition, the violation of federal law is punishable according to the bill, a state law also. The problem is deciding whether the strict enforcement by state law is preempted by federal law. The Arizona District Court and the 9th Circuit Appeal Court interpreted through Immigration and Nationality Act §287(g) that the Congress intended to limit a state’s authority to enforce federal law with agreement of the federal government, and decided that the bill of Arizona is preempted by federal law. The Supreme Court has not yet decided its position.
