국문 초록

형사절차에 있어서 외국인 범죄의 경우 통역에 의하여 그 결과가 좌우된다고 하여도 과언이 아니다. 그럼에도 불구하고 현행법상 외국인 범죄자의 경우 통역을 받을 권리에 대한 보장은 다소 미흡하다고 생각된다. 여기서 인권보장에 있어서 가장 효과적인 국제규범 중의 하나인 유럽인권협약, 특히 공정한 재판을 받을 권리의 일환으로 규정된 통역을 받을 권리에 관하여 개관하고 이와 내용이 동일한 시민적 및 정치적 권리에 관한 국제규약에 있어서의 관련규정에 관하여도 살펴보았다. 아울러 이러한 논의를 바탕으로 현행 형사절차를 수사단계, 공소단계, 공판단계 및 집행단계로 구분하여 각각의 단계에 있어서의 통역을 받을 권리에 관하여 검토하였다. 유럽인권협약이 외국인에 대하여 통역을 받을 권리의 실질적 보장을 위해 요구하는 사항은 다음의 세 가지로 요약될 수 있다고 본다. 즉, 첫째 이해할 수 있는 언어에 의한 통역, 둘째 실질적으로 방어권을 보장할 수 있는 정도의 품질에 의한 통역 및 셋째, 본인의 경제적 자력과 상관 없이 완전 무료에 의한 통역이 그것이다. 이러한 관점에서 볼 때 집행단계를 논외로 한다면 수사단계에서는 위의 세 가지 사항이 모두 미흡하고, 공소단계와 공판단계에서는 2004년 대법원에 의하여 통역ㆍ번역 및 외국인사건처리예규가 제정됨으로써 상당한 부분의 보완이 이루어졌지만 두 번째 사항과 관련하여서는 여전히 미흡한 것으로 판단 된다. 다만, 유럽인권협약에 있어서도 무료에 의한 통역지원은 피고인에게 제공되는 것이다. 그러나 재판결과가 수사단계에서의 통역인에 의하여 크게 좌우된다고 볼 때 무료에 의한 통역지원도 수사단계에서부터 제공되는 것이 타당하다고 본다. 향후 외국인에 대하여 국제 수준의 통역을 받을 권리를 보장하기 위하여는 현행법에 대한 개선이 필요하고, 나아가 행정명령이 아니라 법률에 의한 보장이 필요한 것으로 진단된다.

영문 초록

It is not an exaggeration to say that the result of criminal procedures depends on interpretation in crimes by foreigners. Nevertheless, I think it is insufficient that the current law ensures the right to interpretation and translation in crimes by foreigners. This paper provides general view of the right to interpretation and translation as part of the right to fair trial in the European Convention on Human Rights, one of the most effective international rules in human rights and also examines the relevant provisions in the International Covenant on Civil and Political Rights. In addition, on the basis on above discussions, this paper reviews the right to interpretation and translation in current criminal procedures, especially the right to interpretation and translation in investigation procedure, in prosecution procedure, in trial procedure and in execution of sentence procedure.
