경찰의 드론 활용에 대한 규제

국문 초록

본 연구는 경찰의 드론 활용에 대한 규제에 대한 미국의 각 주별 입법례를 조사하고 국내 시사점이 무엇인지 밝히기 위한 목적으로 수행되었다. 미국의 경우 2014. 6. 30. 기준으로 총 13개 주에서 경찰의 드론 활용에 대한 규제 법률이 통과되었다. 반면 국내의 경우 형사소송법, 개인정보보호법, 항공법에서 경찰이 드론을 활용하는 경우에 대한 직접적인 규제가 존재하지 않으며, 제19대 국회(2012~2016년)에 제출된 개정 법률안을 살펴보더라도 경찰 등 수사기관의 드론 사용에 대한 직접적·명시적 규제를 담은 안이 존재하지 않는다. 또한 경찰 등 수사기관의 드론 사용에 대한 규제 논의도 상대적으로 활발하게 이루어지지 않고 있다. 그러나 이미 국내에서도 경찰이 드론을 수색 업무에 사용한 사례가 있으며, 자체 개발을 통하여 경찰 업무용으로 특화한 드론의 자체개발을 추진 중이다. 따라서 향후 경찰 등 수사기관에서 드론을 치안 목적으로 본격적으로 사용하게 될 경우 경찰의 드론 사용과 이로 인한 프라이버시 침해에 대한 논의가 활발하게 이루어질 것으로 예상된다. 본 연구에서는 총 13개 주 중 Florida부터 Idaho, Illinois, Iowa, Tennessee, Virginia까 지 6개 주의 법률 내용을 살펴보았으며, 영장주의의 원칙과 예외사유, 정보 보유의 제한, 위법하게 수집된 증거능력의 배제, 보고 의무 등에 관한 내용을 담고 있는지의 여부를 기준으로 분석을 실시하였다. 나아가 경찰의 드론 사용에 대한 규제가 특별히 존재하지 않는 국내의 현실에서 경찰이 드론을 사용할 경우 현행 항공법, 개인정보보호법, 형사소송법에 따른 규제가 어느 정도까지 이루어질 수 있는지 검토하였으며 현행법만으로는 한계가 있다는 점을 지적하였다. 마지막으로 경찰의 드론사용에 대한 규제입법이 필요하며, 형사소송법을 개정할 경우 영장주의의 원칙과 예외, 정보 보유기간의 제한, 정기 보고 및 정보 공개 의무, 권리 침해에 대한 구제 방안에 관한 내용을 담을 수 있다는 점을 제안 하였다.

영문 초록

This article examines drone regulations when used by police in the United States at the state level, and thus provides foreign legislative information to South Korea. In the United States, by June 30th, 2014, 13 states passed police drone regulation bills. However, South Korea has no article regarding police drone regulation in the Criminal Procedure Act, Personal Information Protection Act, or Aviation Act. There have also been no bills submitted to the 19th National Assembly (2012~2016) to-date. Moreover, it is relatively more difficult to find information concerning police drones and privacy debates than it is to unearth private drone debates. Nevertheless, in South Korea it was reported that the police used a drone to find a missing person, and that they are currently carrying out research for a specialized police drone for safety and security. When the police start to use drones widely it is expected that their usage and privacy debates will become significant issues. The research focused on state level drone regulations in six states - Florida, Idaho, Illinois, Iowa, Tennessee, and Virginia, and analyzed whether the regulations possessed such areas as warranty and exceptions, data retention, illegal evidence admissibility, report and public duty. Whether the current Criminal Procedure Act, Personal Information Act, and Aviation Act in South Korea can regulate police drones without having new regulations was also analysed, and the conclusion is that current law cannot regulate police drones properly. Consequently, new regulations are thus required to regulate police drones, and should contain such areas as warranty and exceptions, data retention, reporting and public duty, and prevention and remedy.
