국문 초록

美 Pro-patent 정책의 영향과 지식으로서의 기술 및 권리로서의 기술이 분리되면서, 특허분야 내 Trolling을 하는 특허괴물의 존재는 특허권 강화에 따른 잠수함 특허 등과 함께 하나의 현상으로 대표되어 왔다. 더하여, 최근 미국에서는 NPE의 활동 무대가 기존의 IT분야에 국한되지 않음을 알 수 있다. 그 동안 바이오 및 제약 분야는 Patent trolling으로부터 안전하다고 여겨져 왔으나, NPE 기업이 바이오 제약 특허를 매입하기 시작했다는 사실이 밝혀지면서 이에 대한 실질적인 의문이 제기되고 있다. 본고에서 살피고자 하는 BioㆍPharmaceutical 산업은 대규모 자본과 급격한 발전 속도를 보이고 있는 IT 분야에 비해 존재감이 낮은 것이 사실이다. 그러나 의약품의 중요성과 고부가가치 산업으로의 잠재성은 자명하다. 미국 發 NPE의 활동에 무방비 상태인 현재, 일련의 변화들과 함께 진화하는 Patent Trolling을 방어하는 법적 시나리오와 연관 문제들을 검토해 봄은 반드시 필요한 작업이라고 할 수 있겠다. 또한, 특허만료 시점과 맞물려, 복제의약품 중 Biosimilar 시장은 우리나라 제약회사들이 재도약 할 수 있는 발판의 기회가 될 가능성이 될 것이다. 이는 NPE의 공격에 대비가 선행되어야 함이 분명하고, 다행히 바이오 및 제약 분야에서의 NPE의 활동은 예측가능하며 미국에서도 아직 활동 초기 단계이므로, 이러한 문제를 인식하고 동 문제가 산업 전반으로 확산되기 전에 관련 입법적 조치를 마련하여야 할 것이다. 변화를 거듭하고 있는 현재 우리나라 바이오 및 제약 분야에서의 Patent trolling 현상에 따른 문제점을 예측하고 의약품 특허의 발전방향을 중점으로 살펴보고자 한다.

영문 초록

Patent trolls also known variously as non-practicing entities, patent assertion entities, and patent monetizers, especially in IT. In the recent reviews, however, bioㆍ pharmaceuticals are paradigmatically centered on patents. Therefore, the Bioㆍ pharmaceutical patent issues are on the rise with patent trolling. Biosimilar refers to a generic drugs of biomedicine, there are some risk for biosimilar development. but the generic drugs have many benefits and it is worth to develop. So, at the national level, the government must protect the national biosimilar industry and establish and push forward policies to encourage the development. Because, internationally terminations of blockbuster biomedicine patents arrives before and after 2013, a new market of biosimilar will be formed and all countries of the world are actively responding to a development of biosimilar by preparing biosimilar approval regulations and related legislations. This study analyzed the definition of bioㆍpharmaceuticals and the current research and Korea-US FTA, examined national and international bioㆍpharmaceuticals related regulations, observed areas which may be issued by patent dispute and strategy which are helpful in patent trolling of NPEs. the study focused on system to compare with the US standards, in addition, in regards to the ways of possible legal protection of bioㆍpharmaceutical patents and the study attempted to seek for legal and institutional protection ways for a successful access to international markets by national bioㆍ pharmaceutical industries.
