국문 초록

한미 자유무역협정(이하 한미 FTA 로 표시)은 미국 Washington DC 현지 시각으로 2007년 6월 3 0일(토) 오전 10시 (한국 시각으로는 2007년 6월 3 0일(토) 오후 시시) 미국 하원 Cannon 빌딩에서 한국과 미국 양 정부 대표에의해 공식 서명되었다. 이와 더불어 2007년 5 월 1일 대외경제장관회의에서 한-EU FTA 협상 개시를 결정하고 같은해 5월 6일 한-EU 통상장관회담(개최지: 서울)을 갖고 협상 출범을 공식 선언하였다. 이후 2008년 2월말까지 6차례의 협상을 진행하였다. 우리나라가 수 개의 자유무역협정을 동시다발적으로 추진하다 보니 일관성 있는 입법 이행을 추진하는 것이 생각보다는 쉽지 않은 경우도 발생할 수 있다. 이러한 우려가 기우이기를 바라는 마음에서 한미 R A 의 결고■ 바탕으로 한-EU FTA협상의 상대방인 리 의 법제를 면밀히 검토할 필요가 있다. 한미 FTA 뿐만 아니라 한-E니 RTA협상에서도 중요 쟁점으로 부각되고 있는 분야 중 하나가 지적재산권 집행 분야다. 본고는 지면의 한계상 지적재산권 집행 분야 중 잠정적 구제책(Provisional measures) 및 교정적 구제책(Corrective measures)을 중심으로 살펴보기로 한다. 특히 이와 관련하여 본고는 두 가지 쟁점을 중심으로 고칠한다. EU 지적재산권집행지침 제11조에 따르면, EU 회원국은 제3자가 지적재산권을 침해하기 위하여 사용한 서비스를제공한 중개인(intermediary)에 대해 금지명령을 신청할 권한을 지적재산권자에게 부여하도록 보장하여야 한다. 또한 EU 지적재산권집행지침 제9조에서는 전술한 유형의 중개인에 대해 중간적 금지명령을 내릴 수 있다고 규정하고 있다. 이와 관련하여 우리나라의 경우에 침해물임을 모르는 택배회사 등 중개인에 대하여 가처분을 할 수 있는지 여부를 살펴본다. 그리고 한미 FTA에 관련해서 침해행위와 사용된 재료나 도구도 압류 및 폐기할 수 있도록 되어 있다. 미국의 경우에 어느 정도까지 재료나 도구를 압류 내지 폐기할 수 있는지 여부를 살펴보고,한미 FTA를 이행하기 위하여 추가의 법 개정이 필요한 지 여부를 검토한다.

영문 초록

The landmark free trade agreement between South Korea and United States (hereinafter KORUS FTA ) was officially signed by the representatives of both countries in a ceremony held in the Cannon building Office on Capitol Hill at 10 am on June 30th 2007 (ET) (at 11 pm June 30th 2007 (Korean Time)). Furthermore, South Korea decided to commence the FTA negotiation between South Korea and EU on May 1st 2007 at the meeting of ministers in charge of Korean international economy. On May 6 2007, the representatives of South Korea and EU have a meeting at Seoul and officially declared commencement of the FTA negotiati에 between South Korea and EU. Carrying out the negotiatk)n of several FTA simultaneously may result in inconsistent legislative implementation following the closing of FTA negotiation. Hoping it is a groundless fear, we need closely review EU law on which the representatives of EU will expected to base their negotiation proposals. Intellectual property enforcement is one of the important fields in KORUS FTA and FTA negotiation between Korea and EU. Especially, the Article will focus on provisional and corrective measures of intellectual property enforcement. According to article 11 of EU Intellectual Property Enforcement Directive (hereinafter EU Directive ), EU Member States shall ensure that the judiciary authorities may, at the request of the applicant, issue an injunction against an intermediary whose services are being used by a third party to infringe an intellectual property right. Also, article 9 of the EU Directive provides that EU Member States shall ensure that an interlocutory injunction may be issued, on the same condition, against the intermediary. In this regard, the Article inquires whether provisional measures may be issued against a bona fide intermediary who delivers an infringing goods in Korea. Meanwhile, materials or implements used to infringe intellectual property rights may be impounded or destructed in accordance with KORUS FTA. Here, the Article delves into to what extent the materials or implements can be impounded or destructed and whether the further revision of Korean intellectual property laws is necessary to implement KORUS FTA.
