최근 일본의 저작권법개정에 관한 소고

국문 초록

본고는 1990년대부터의 일본의 저작권법 개정과정을 개관한 후 몇 개의 토픽에 관하여 중점적으로 살펴본 것이다. 일본 齊確博교수는 일본 저작권법의 개정사 내지는 발전사를 다음과 같이 4기로 구분한다. 제1기는 구법시대로 1899년 구저작권법이 제정되고 1939년 중개업법을 거쳐 1970년 전면개정에 이르기까지이다. 제2기는 전면개정시대이다. 1960년대 전면개정을 하려는 움직임과 더불어 저작권제도심의회가 마련되고 1970년 전면개정에 이르게 된다. 제3기는 소폭개정시대이다. 1970년 전면개정이후 1994년 m〇 협정 체결에 수반하는 개정까지가 이시기에 속한다. 제4기는 아날로그 디지털 혼재의 시대이다. 대체로 1990년대 후반부터 현재까지를 »專교수는 제4기로 분류한다. 본고에서는 이중 1990년을 기점으로 하여 살펴본 것이다. 일본에서는 1990년 이래 13차례의저작권법 개정이 있었다. 이 중 본고에서는 사적녹음녹화에 대한 보상제(1992년 개정법)，공중송신권 및 송신가능화권, 기술조치 및 권리관리정보의 보호> IP 멀티캐스트 방송에 대응한 개정에 대해서 중점적으로,살펴보았다. 아울러 이른바 프로바이 더 책임법, 저작권등관리사업법, 영화도촬(盜樓)방지법에 대해서도 살펴보았다. 이를 바탕으로 우리법상 개정되거나 변경되는 것이 바람직한 부분에 대해서 간단히 언급하였다.

영문 초록

This paper is on the recent revised contents of Japanese copyright act and copyright related acts. Japanese professor Saito Hiroshi classified the legislative history of copyright in Japan under 4 periods. The first periods is from 1899 to 1939(old act period). The Second period is 1970 when current act was enacted. The third period is from after 1970 to 1994 when WTO treaty was concluded. The fourth period is from 1996 which is Digi-logue era(Analogue-Digital Mixed Era). In spite of afore-mentioned view, this paper surveys from 1992 when “Compensation for Private Recording system was adopted. As we know, and like other developed countries do, for the response to rapidly advancing technological innovations, the emergence of new types of business, and development of globalization etc., Japanese legislator revised the copyright act many times from 1992 and has legislated some specific acts which is closely related to the copyright. After the brief survey of Japanese copyright revision history from 1992, this paper focuses on ① Reproduction for private use(§30), ② Public transmission right(including right of “making transmittable to the public)(§23), ③ the Technological protection measures(anti-circumvention clause) and copyright management information(§2① x x and x xi, §113, §120-2), and ④ IP multicast revised clauses(§38②，§94-2，§95©, §97©, §102(IMD etc.) in copyright act. This paper also refers to ① Online Service Provider Responsibility Limitation Act which was enacted in 2001, ② the Act for Collective Management of Copyright and Related Rights which was also enacted in 20이， and @ the Act for Unauthorized Recording of Motion Pictures in a Motion Picture Exhibition Facility which was enacted in 2007. Depending on this survey, this paper suggests some revising points to the present korean copyright system.
