국문 초록

추급권은 미술작품이 최초 판매된 후 재판매될 때마다 일정비율의 사용료를 해당 작품의 작가가 받을 수 있는 권리를 말한다. 국내에 추급권제도 도입에 대한 논의는 한-EU FTA를 통해서 촉발되었지만 한-EU FTA와는 별개로 미술품 거래의 투명 화와 미술작가에 대한 지원이라는 미술시장정책 차원에서도 현재 추급권제도 도입 자체를 검토할 수 있다고 본다. 본 연구는 3년간(2010-2012)의 국내 미술품 재판매 거래 데이터를 사용하여 국내 추급권료 규모를 추정하고 추급권료에 의한 소득 재분배효과를 분석하였다. 추급권료 징수 대상을 최저거래 한도 100만원과 400만원의 두 가지 시나리오로 분석한 결과, 연간 추급권료 시장 규모는 11억원 내지 13억원 정도로 추정되었다. 추급권료를 징수하고 배분하는 간접적인 비용을 제외하면 실제 미술작가에게 배분되는 것은 연간 약 10억원 규모가 될 것으로 예상되었다. 추급 권료 징수에 따른 소득재분배효과를 분석한 결과, 생존작가는 작고작가에 비해 1인당 평균 추급권료 측면에서 2배 내지 3배 정도 적었으며, 추급권료 상위 50 작가와 그렇지 않은 작가간의 추급권료 분배의 비대칭은 더욱 심하였다. 또한 추급권 제도의 혜택은 현존작가 내에서도 원로작가 및 유명작가에게 돌아가는 등 추급권료 혜택 작가간 분배의 비대칭성이 심한 것으로 확인할 수 있었다. 하지만 당초 우려하였던 추급권 제도를 도입할 경우 외국작가에게 상당부분의 혜택이 돌아갈 것이라는 것은 사실과 다른 기우에 불과하였다.

영문 초록

The resale royalty right is a right granted to artists or their heirs to receive a fee on the resale of their works of art. In some jurisdictions which implement the resale royalty right artists have the right to control or profit from subsequent sales. In Korea, the question on whether to introduce the resale royalty right was one of hot issues in Korea-European Union (EU) Free Trade Agreement(FTA) in 2007. Although it was not included in the FTA agenda, Korea and European Union agreed to reconsider the introduction of the resale royalty right after two years of FTA during the negotiation. However, there is no discussion about the resale royalty right as of 2014. This paper analyzes the economic validity of the resale royalty right on the profit of the artist. In order to do this, we established two scenarios which are one million won and four million won respectively based on lowest seller/buyer price criteria. Two scenarios is same below: Single payments cannot exceed 175 million won(？？12,500) and royalties are set at the EU s rates. The Resale Royalty Right applies to original artworks by living artists and for a period of 70 years after an artist s death. Our main results are as follows. Based on auction house data, we estimate that about 1.1 billion won or 1.3 billion won of royalty right is being collected annually, of which around 65% accrues to top 50 artists.
