국문 초록

최근 한 EU FTA의 협정문이 우리나라 국회를 통과하여 오는 7월 초에 발효될 예정으로 있다. 한 EU FTA에서 저작권 분야의 중요한 주제 중 하나는 저작권보호기간의 연장이다. 1993년 제정된 유럽의 저작권보호기간지침은 이미 저작권보호기간을 저작자 사후 50년에서 70년으로 연장하였고, 이는 미국의 저작권법(DMCA)에도 영향을 미친 것으로 알려져 있다. 우리나라의 저작권법도 한 EU FTA 협정문에 따라 조만간 저작권보호기간을 저작자 사후 70년으로 연장해야 할 것이다. 그렇다면 저작권보호기간의 적절한 보호기간은 과연 언제까지일까 의문이다. 저작권법제사 측면에서 보면 저작권 보호기간은 계속 연장 되어 왔는데, 이러한 흐름이 언제까지 이어질지 정확히 예측하기가 어렵다. 한편 저작권보호기간에 관한연구는 그 중요성에도 불구하고 그동안 우리나라에서 충분한 담론이 형성되어 오지 않았던 것 같다. 저작권보호기간의 연장이 미치는 영향이 중요한 만큼 우리나라에서 이 분야에 관한 법률적, 정책적, 경제학적분석과 연구가 진행되어야 할 것으로 보인다. 본고에서는 유럽과 미국에서 저작권보호기간 연장에 관한 찬반론 주장들을 살펴보고, 저작권보호기간 연장이 과연 어떠한 의미를 가지는지에 대하여 고찰하고자 한다.

영문 초록

Recently Korea-EU FTA has been passed by the National Assembly and will be enforced in the beginning of July 2011. One of the important issues of Korea-EU FTA is relating to elongation of the term of protection of copyright. According to the European Copyright Directive established in 1993 the term of protection of copyright has been changed from 50 years to 70 years after the death of author. Therefore, the Korean Copyright Act shall be revised according to the Korea-EU FTA, in other words, the term of copyright protection will be extended from 50 years to 70 years after the death of author. It may be asked of how long the term of protection of copyright should be protected. From the perspectives of copyright history the term of protection of copyright has been continuously extending, and it is so difficult to predict until when this tendency extending the term of protection of copyright would be continued. On the other hand, it is even important to study on term of protection of copyright, however, it does not seem to be satisfactorily discussed on this issue in Korea. Thus, it is necessary to analyze and study on the term of protection of copyright not only from legal but also policy and economic perspective. In this study pro and contra on extending the term of protection of copyright mainly in Europe and U.S. will be dealt with, and will be examined which meaning it has in Korea to extend the term of protection of copyright.
