국문 초록

본 연구는 경찰관 이해충돌 회피를 위한 근본적인 대책을 제시함을 목적으로 경찰관의 직무수행에서 나타나는 이해충돌의 특성과 현행 이해충돌 방지에 관한 법제도를 분석하여 문제점을 도출하고 외국 경찰의 이해충돌 관리체계를 분석하여 개선점을 찾고자 한다. 경찰업무에서 발생되는 이해충돌은 보통 경찰관으로서의 역할과 개인적 이해관계 사이의 충돌 또는 한 명의 경찰관이 갖는 두 가지 역할 사이의 충돌에서 발생된다. 경찰공무원의 이해충돌은 경찰활동에 있어 많은 문제를 야기한다. 경찰관이 직무수행 중 이해충돌에 의해 내린 판단은 부당하거나 불법적인 직무수행으로 나타날 수 있고, 경찰조직과 같이 직무수행에 있어 엄격한 공정성과 합법성이 요구되는 조직의 경우 설령 경찰관이 철저하게 공평무사(公平無私)하게 직무를 수행했다고 하더라도 이해충돌은 경찰관의 직무수행을 외형상 편파적인 직무수행으로 보이게 만든다. 경찰관은 구체적인 직무를 수행하는 과정에서 자신에게 부여된 여러 가지 권한을 적절하게 행사하여 필요한 조치를 취할 수 있는 재량권이 있다. 이러한 재량권 행사 과정에서 상대적으로 빈번하게 이해충돌에 노출될 수 있고, 이해충돌 회피에 실패할 경우 직무수행의공정성을 훼손하거나 부패행위로 발전될 수 있는 것이다. 따라서, 경찰관 이해충돌의 특성과 윤리적 측면을 고려하여 경찰관 개개인이 이해충돌을 관리(managing conflict of interest)할 수 있는 이해충돌 회피 제도를 마련해야 한다.

영문 초록

Conflicts of interest can arise for police in a number of ways. In police work most conflicts of interest involve a conflict between an police officer s role and an his private interest, or between two roles of an police officer. A police officer whose judgement is clouded by a conflict of interest may be led into inappropriate or illegal conduct. Even when an officer acts completely impartially, conflicts of interest tend to create the appearance of bias in the discharge of his duties. The appearance of bias in policing is a significant problem in positions of public trust. Policing is only truly effective when police personnel are respected and trusted by the community. The problem caused by conflicts of interest may make erode that trust and diminish the authority, reputation and effectiveness of Police. Thus the priority should be given to the issue of the avoidance of conflicts of interest in policing. There is a shared responsibility between individual officers and police organization to manage all conflicts of interest. And it requires more specific and detailed strategies to manage conflicts of interest.
