人工知能(로봇)의 법적 쟁점에 대한 試論的 考察

국문 초록

인공지능로봇이 가져올 사회적 변화는 작지 않을 것으로 예상된다. 특정한 상황을 넘게되면 인공지능은 인간과의 법률적 차이를 넘기 어려울 수도 있을 것이다. 법이 기술이나 사회현상을 따르지 못한다는 비판은 어느 정도 타당성을 갖는다. 다만, 법이 선도적으로 기술을 시뮬레이션하여 대응하는 것은 법적 안정성이라는 측면에서 문제가 될 수 있다. 확정되지 않은 현상과 기술에 대해 법적 재단을 할 경우, 기술이나 현상에 대한 유연성이 떨어질 수 있기 때문이다. 이러한 접근법은 기술의 발전에 저해되며 자칫 규제로 작용할 수 있다는 한계를 지닌다. 따라서 기술현상에 대해서는 정책적 접근을 통해 유연하게 대응하는 것이 타당하다. 물론 현행 법체계에서 로봇은 권리의 주체로 보기 어렵다. 로봇의 지위에 대해서는 동물권 유사 개념으로 로봇에 대한 법률관계의 고찰을 통해 힌트를 얻을 수 있을 것이다. 현행법상 인공지능로봇으로 인해 발생하는 법적 책임은 소유권을 갖는 소유자 의 몫이다. 또한 로봇이 창작한 기사나 그림과 같은 저작권은 누구에게 귀속되는지도 논란이 될 것이다. 현행법상 저작자 또는 발명자는 자연인으로 한정되기 때문에 로봇이 권리자가 될 수는 없다. 또한 소유자로 보기도 어렵다. 로봇이 만들어낸 결과물에 대해서는 부정경쟁행위가 아니라면 누구나 자유롭게 이용할 수 있는 문제가 발생한다. 이는 지식재산권의 권리관계에 있어서 법적안정성을 해할 수 있다. 업무상저작물이나 직무발명의 범위에 인공지능에 의해 만들어낸 것도 포함하는 입법론적 방안이 해결책이 될 수 있다. 일부에 대해 살펴보았지만, 인공지능을 포함한 지능사회에 대비하기 위한 전반적인 법제도의 정비가 필요하다. 새로운 거버넌스가 필요한 지, 로봇윤리와 도덕은 어느 수준으로 해야할 지 등 다양한 논의를 통해서 로봇과 인간이 공존하는 사회를 대비할 수 있어야 할 것이다.

영문 초록

Therefore, it is appropriate to respond flexibly through a policy approach for technology development. Of course, in the current legal framework it is difficult to see the robot as a subject of rights. Similar to the concept of animal rights for the position of the robot through a review of the legal relations of the robot will be able to get a hint. Legal responsibilities arising from the current law on artificial intelligence robot is up to the owners with ownership. In addition, copyright, such as articles or images created by the robot will be a controversial map that belong to anyone. Current law on the author or inventor can not be limited to natural persons, since the robot owner. It is also difficult to even see the owner. If the result is unfair competition for robots created all the problems that can occur freely. This can harm the legal stability in the relationship between intellectual property rights. This holistic measures including legislation also created by the artificial intelligence in the scope of work or work-related duties invention may be a solution. Looked at for some, there is a need for maintenance of the overall legal system to prepare for the intelligence community, including artificial intelligence. We need a new governance, ethics and morals robot will be able to prepare a society in which robots and humans coexist through various discussions, such as how to do a certain level.
