인터넷 망 중립성의 변화에 따른 규제 방안

국문 초록

미국 연방통신위원회(Federal Communications Commission: FCC)는 2014년 5월 15일에 Google, Facebook, Netflix 등과 같은 인터넷 콘텐츠 사업자들이 망을 소유한 통신 사업자에게 추가 비용을 지급하면 보다 빠른 인터넷 회선을 이용할 수 있도록 한 망중립성(Net Neutrality)에 관한 새로운 개정안(Protecting and Promoting the Open lnternet)을 발표하였다. 이번 개정안은 올 1월 14일에 있었던 연방항소법원의 Verizon판결을 반영한 것으로 트래픽(traffic)이 많은 일부 사용자에 대하여 일정한 제한을 할수 있도록 허용하고 있다. 이는 최근까지 유지해 왔던 망 사용자에 대한 차별금지 원칙에 큰 수정을 가한 것으로 평가된다. 이번 개정안에 대하여 통신사업자들은 장기적으로 서비스 품질의 향상과 소비자 권익을 향상시킬 것으로 전망하고 있는 반면 콘텐츠사업자들은 강하게 반발하고 있다. 이 글은 미국 FCC가 새롭게 마련한 망 중립성 규정과 Verizon 사건을 상세히 분석하고, 이를 토대로 망 중립성과 관련된 법적 쟁점을 살펴보고 그 해결 방안을 제시하고 있다. 특히 망 중립성 정책을 결정함에 있어서 새로운 실용적 접근의 필요성을 강조하고, 이를 위해 시장의 경쟁상황, 고용량 콘텐츠의 증가 등 변화된 시장 환경을 고려할 것을 제안하고 있다. 2013년 12월 미래창조과학부가 마련한 ｢통신망의 합리적 관리⋅이용과 트래픽 관리의 투명성에 관한 기준｣은 트래픽 관리를 “합리적인 범위내에서 제한적으로” 시행하고, 서비스의 품질, 용량 등에 비례한 요금을 책정할 수 있도록 규정함으로써 시장 환경의 변화를 고려할 수 있도록 하고 있다. 이 글은 FCC의 새로운 규정이 네트워크에서 트래픽 과부하를 일으키는 콘텐츠사업자에게 추가 요금을 부과할 수 있도록 한 점과 관련하여 급속히 변화해 가는 인터넷시장 환경에 대응하기 위해서는 망 사업자와 콘텐츠사업자 간의 협력이 필수적임을 강조하고 있다. 대규모 트래픽을 이용하여 수익을 창출하는 콘텐츠사업자가 그 수익의 일부를 망 고도화를 위해 투자하는 것은 망 사업자는 물론 콘텐츠사업자에게도 윈-윈(win-win)한 결과를 이끌어낼 수 있다. 아울러 소수의 해비유저(heavy user)가 트래픽 절반 이상을 사용하는 소위 트래픽 사용의 쏠림 문제를 해소하기 위하여 형평성과 시장원리에 기초한 종량제 요금제의 단계적 도입을 검토하고 있다.

영문 초록

The Federal Communications Commission (FCC) in United States passed a new proposal, “Protecting and Promoting the Open Internet”, which was a provisional set of rules regarding net neutrality on May 15, 2014. The amendment allows broadband providers to deal with fast lanes or paid prioritization arrangements as long as it is commercially reasonable and guaranteed a minimum level of quality for every service. This new rule has been introduced after Verizon succeeded in striking down most of the 2010 Open Internet Order, especially anti-blocking and anti-discrimination rules in Verizon v. FCC of 2014. The new rule is substantial change of a net neutrality policy. After examining the rule and Verizon case, this article insists that a market based approach would be desirable in operating a net neutrality policy because it is not an unchangeable principle and is different in each country. As EU regulation and especially Ofcom’s approach to traffic management, the policy needs to rely primarily on effective competition among Internet Service Providers (ISPs). Not only should ISPs convey all traffic on more or less equal terms, but also can prioritise certain traffic if the amounts of discrimination enhance efficiency. In December 2013, the Ministry of Science, ICT and Future Planning in Korea announced a new standard for traffic management including such consideration, and allowed limited discrimination based on service quality and volume of traffic within the reasonable scope. This article also addresses a need for cooperation between broadband providers and certain content providers such as Google, Facebook, and KakaoTalk who cause exceed traffic load, in terms of investment in networks. It is proper that certain portion of profits obtained from heavy traffic using it should be invested to develop the network. By the same token, it also examines the need for gradual introduction of the usage-based pricing model for Internet services in Korea.
