무면허의료행위와 한의사의 진단용 의료기기 사용에 관한 고찰

국문 초록

우리나라는 의료인에서 의사와 한의사를 구별하고 있고, 양방의료행위와 한방의료행위를 구별하는 이원적 의료체계를 지니고 있다. 그리고 의료법상 면허의 종별에 따라 그 면허의 범위 내에서만 의료행위를 수행할 수 있도록 규정하고 있기 때문에, 면허 외의의료행위역시 무면허의료행위에 해당하게 된다. 그러므로 한의사가 의사의 면허 범위내에 있는 의료행위를 행하거나 혹은 의사가 한의사의 면허 범위 내에 있는 의료행위를 행한 경우 모두 무면허의료행위로 형사적･행정적 제재를 받게 된다. 대상판결은 한의사가 환자에 대하여 파킨슨병, 치매질환과 같은 뇌질환을 진단하기 위하여 양방의 뇌파계 진단용 의료기기를 사용한 것이 문제된 사안이었다. 뇌질환의 경우 면밀한 진단이 필요한 영역으로, 해당 질환에 대하여 조기 진단과 치료에 실패할 경우 환자의 건강권에 대한 침해가 우려된다. 또한 뇌파계 진단용 의료기기가 비록 귀적외선체온계 등과 같은 안전등급에 해당한다고 할지라도, 진단하려는 해당 질환의 성격에 비추어 볼 때 동일하게 취급하기는 어렵다. 따라서 본고에서는 양방의료행위와 한방의료행위를 어떻게 구별하여야 하는지 그 기준에 대하여 살펴보고, 의료행위 중 진단행위가 지니는 의의와 특수성을 검토한 후, 우리나라 법원의 판례와 헌법재판소 결정에서 한의사의 양방의 진단용 의료기기 사용에 관하여 어떻게 판단하였는지에 관한 동향을 점검하여, 대상판결을 분석하고 향후 한의사의 양방의 진단용 의료기기 사용에 대한 판단기준을 제시하고자 한다.

영문 초록

In Korea, Western medicine doctors and Korean medicine doctors are distinguished among the medical practitioners group, and Western medical practice and Korean medical practice are distinguished within a dualistic medical system. As the scope of medical practice is regulated by the type of licence granted under the medical law, medical practice outside the scope of the license is considered unlicensed medical practice. Therefore, if a Korean medicine doctor performs medical practice that is only granted to the license of Western medicine doctors, or vice versa, such performance shall be considered unlicensed medical practice subject to criminal and administrative sanctions. The issue of this case arose from the use of a bidirectional electroencephalograph diagnostic medical device by a Korean medicine doctor for diagnosis of Alzheimer’s and Parkinson’s disease. Encephalopathy requires precise diagnosis, where failure of early diagnosis and treatment can result in infringement of patients’ right to health. Even though electroencephalograph diagnostic medical devices are in the same safety grade as ear infrared thermometers, the type of diseases for diagnosis differ so much that the same treatment is inappropriate. Therefore, this paper discusses how to distinguish between Western medical practice and Korean medical practice and examines the standards for such distinction. Then, within medical practice, the meaning and the special characteristics of diagnosis practice shall be discussed. Korean court decisions and the Korean Constitutional Court decisions discussing the use of Western diagnostic medical devices by Korean medicine doctors shall be analyzed. We shall then propose the determining standards for the use of Western diagnostic medical devices by Korean medicine doctors.
