형사소송법 제313조 개정 유감

국문 초록

2016년 5월에 형사소송법 일부가 개정되었다. 개정된 내용은 제35조 3항, 제314조, 제440조 등인데 가장 중요한 부분은 바로 제313조 1항을 개정하면서 2항을 신설한 것이다. 위 개정 내용을 요약하면 ① 문자 등 정보가 서면이 아닌 정보저장매체에 저장되어 있는 경우에도 진술서 또는 진술기재 서류의 법리를 그대로 적용하는 것으로 확장하였고, ② 작성자의 진술에 의하여 그 성립의 진정함이 증명되지 아니한 경우에도 객관적방법으로 성립의 진정함을 증명하는 것으로 대체할 수 있도록 하면서 ③ 일부 경우에는 피고인에게 반대신문의 기회를 부여하였다고 정리된다. 이 글에서 필자는 위와 같이 개정된 각 내용이 과연 적절한지, 위 개정이 그간 제기되어 온 여러 문제점들을 충분히 고려하여 해결하고 있는지를 검토해 보았다. 그 결과 제313조와 관련하여 그간 제기되어 온 많은 문제들 중 이번에 일부만 개정되고 나머지 대부분은 외면되었으며, 개정된 내용도 앞에서 살펴본 바와 같이 매우 허술하다는 사실을 알게 되었다. 그간 여러 글을 통해 제313조의 문제점으로 공통 중 가장 큰 것은 제313조 1항이 진술서와 진술기재서류, 작성자 또는 원진술자가 피고인 본인인 경우와 제3자인 경우를 한꺼번에 서술하는 바람에 국어적으로 혼란스럽게 되었다는 점이다. 피고인의 진술서, 피고인 아닌자의 진술서, 피고인의 진술기재서류, 피고인 아닌 자의 진술기재서류, 이렇게 4가지로 나누어 규정하면 아무런 오해가 발생할 리 없는데 개정법은 이 문제를 해결하기는커녕 2항 본문과 단서 등을 통해 오히려 더 어렵게 만들었다. 더욱이 제1항본문에서 진정성립을 인정할 자가 누구인지, 제1항 단서가 피고인 진술서에도 적용되는지 등에 대하여는 손도 대지 못하였다. 개정 전 법의 문제점도 그러하였지만 이 글에서 지적한 개정법의 문제점도 대부분이 법리적 문제라기보다는 문언적 문제였다. 필자의 지적이 옳다면 제313조는 조속히 재개정되어야 할 것이다. 입법과정에 법리적검토가 중요함은 말할 필요도 없지만 문언적 검토도 그에 못지않게 중요하다.

영문 초록

A part of the criminal procedure code was amended on Monday, 2016. The amended contents are §35 (3). §314, §440, and so on. The most important thing is establishing while they amend §313 (1). To sum up the amended content, ① a case that an information, like a text message, saved at a data storage media, not in writing, although, extends to apply a principle of law about written statement or document recording of oral statement as it is. ② and, although, in a case that the truth of establishment doesn’t prove, by the statement of a person making a statement, replacing to the truth of establishment through the objective way, ③ in a few cases, the accused has an opportunity about a cross-examination. In this entry, this writer reviews that if such a each amended contents is of any proper, and that if this amendment settles several matters that have raised in the past well. As a result, this time, only a part of many problems amended contents are so poor. Meanwhile, through the many writing, a common main problem of §313 is that confused about in language because §313 (1) describes a written statement and document recording of oral statement, preparing person or person who makes an original statement, in case of the accused himself and a third party at once. A written statement of the accused, a written statement of not the accused, a storing article of information of the accused and a storing article of information of not the accused, these four divided articles don’t make any misunderstanding. However, through the body and clue of a §313 (2), the amended law confused this problem worse, let alone any solution. Furthermore, it haven’t even touched who admits the guarantee of cross question right in a body of §313 (1) and that the clue of §313 (1) can be applied in a statement of the accused. Like a problem of the old law, problems of the amended law, this writing pointed, are almost literal things, not a juridical ones, If this writer is right, §313 should be amended quickly. It is so important not only a juridical review in a legislative procedure, but also a literal review.
