국문 초록

그동안 국민의 일상생활에서 자주 발생하는 범죄에 대한 대웅은 형사사법기관의 사후적 개입에 의한 방식으로 이루어져왔으며 잠재적 범죄 위험요소에 대비하는 사전예방적 정책은 미비한 실정이었다. 그러나 1980년대 이후부터 선진국에서는 국가， 지방자치단체， 공공단체 및 지역주민등이 참여하는 협력적 범죄예방체계로 전환하고 환경설계를 통한 범죄예방체계(CPTED)의 구축에 관심을 가지기 시작하였다. 우리나라에서도 2005년 이후 환경설계를 통한 범죄예방체계 (CFIED) 정책이 도입 적용되기 시작하였으나 이러한 정책을 실현하기 위한 지방자치단체의 조례나 관련규정안인 「범죄예방기본법안」은 협력적 범죄예방체계 구축에 있어 매우 미흡하여 정책의 실효성을 담보하기 어렵다는 한계가 있다 현재 국회에는 CPTED 정책을 국가적 차원에서 체계적으로 지원하기 위하여 「법죄예방기본법안」이 상정되어 있다. 그러나 해당 법률안은 CPTED를 적용할 수 있는 시책마련 등에 관한 일반적 조항만을 규정하고 있을 뿐 지방자치단체의 CPTED 정책 추진을 위한 조례 제정의 근거는 규정하고 있지 않는다. 따라서 법률안에 지방자치단체에서 CPTED 조례에 강제성을 가질 수 있는 내용을 규정할 수 있도록 위임근거를 마련하여 실효성을 보장할 수 있도록 하여야 할 것이다.

영문 초록

Since the 1980s, in developed countries legislated CPTED to prevent crime through environmental design. Since 2005，also started to discuss in earnest with respect to the Republic of Korea. CPTED is all not effectively prevent the crime. But CPTED is the chance of a crime and crime prevention strategies for environmental factors of crime and as such, can increase the benefits of the major crime prevention strategy is assessed. Despite some efforts local governments of crime prevention, arises a question about the effectiveness of the content of an ordinance CPTED. In other words, CPTED the most important part of the ordinance not apply to recommended conditions are not forced or efforts to impose a duty his mistake. And allows declarative system also not passed for cooperation with relevant institutions. Therefore, the conditions relevant to cpted cpted Act by enacting a need to provide a delegation so you can have the effectiveness of regulation. Currently the National Assembly has more systematically to support a policy of CPTED 「Framework Bill on crime prevention」 is assumed. But the bill is, only stipulates general provisions only stipulated ordinance is based on the fact that the policies and the basis of local governments can t. This is not evolved than today, driving without the promotion of policies of local government legislation of the bill on track to achieve its objectives. Therefore, to have the force about the bill provided the basis for commission to be able to present the contents of legislation. Will through which to ensure effectiveness should be required to. CPTED policy for continuous propulsion of the delegation provide the basis for the law, above all else, that the most important.
