콘텐츠분쟁조정위원회의 중재제도 도입에 대한 고찰

국문 초록

창조성과 상상력을 기반으로 하는 콘텐츠산업은 새로운 부가가치를 생산하는 우리나라의 미래산업으로 당해 산업분야의 분쟁을 사전에 예방하고 사후에 그 해결을 지원하는 신뢰절차의 구축은 매우 중요한 정책적 이슈이다. 소송을 제외한 분쟁해결방법으로는 조정, 중재와 같은 대안적 분쟁해결(ADR : Alternative Dispute Resolution)이 있는데, 콘텐츠산업과 관련한 ADR기구로 2011년 4월 출범한 콘텐츠분쟁조정위원회가 있다. 조정위원회는 출범부터 2015년 말까지 약 16,000건의 조정신청을 접수받아 처리하는 등 왕성한 활동을 하고 있는데, 최근에는 콘텐츠사업자 간 분쟁이 계속 증가하고 있으며, 이러한 사업자 간 분쟁은 분쟁가액이 크고 사건에 따라서는 조정 외에 중재에 따른 해결방식을 문의하는 당사자들도 있기 때문에 새로운 ADR 기법인 ‘중재’의 도입도 검토가 필요한 시점이다. 콘텐츠분쟁조정위원회에서 현재 진행하고 있는 조정제도는 콘텐츠 분쟁의 사후적 해결을 원만히 지원하는 제도로 그 효용이 매우 크나 향후 적정한 중재제도를 도입하고, 알선, 조정, 중재의 모든 ADR 제도를 WIPO 중재·조정센터와 같이 운영하면 콘텐츠 기업들의 많은 분쟁을 더욱 원활히 처리할 수 있어서 콘텐츠산업에도 크게 이바지할 것으로 기대된다. 특히 콘텐츠 분쟁은 중재로 진행하기에 적정하고, 이미 엔터테인먼트 분야에서는 중재로 분쟁해결을 하는 사례가 있다. 조정과 중재를 병행하고 있는 국내외 분쟁해결기구 사례를 검토한 결과 콘텐츠분쟁조정위원회도 중재절차의 도입과 운영이 필요한 시점이다.

영문 초록

Contents industry that is based on imagination and creative ability is very important in Korea for it provides new high value-added products or services and new innovative business models. Creative Economy give us a heavy challenge to build “Trust Process” that prevent and solve disputes in new business ecosystem. So equitable and immediate dispute resolution system is very meaningful and key issue in development contents industry. Korean Government set up ‘Contents Dispute Resolution Committee(CDRC)’ in 2011 and that committee have managed 16,000 cases from that time to the end of 2015 and have provided ADR (mediation service not arbitration). This Activities of the committee is so successful that it contributes to fair contents industry ecosystem in Korea. But these days disputes cases in contents industry are increasing and there are some persons who wants to resolute disputes by arbitration not mediation. So I think it s a turning point to considerate to bring in arbitration rules into the committee. If CDRC adopts arbitration, it will use all ADR techniques like negotiation, mediation and arbitration and many contents corporations will make use of the ADR process more frequently. For contents disputes are so affordable to arbitration which gives fast track, strict confidentiality, low price and arbitrators are consisted of experts in law, technology, patents and so on. The Mediation system of CDRC is very effective in contents dispute resolution but if CDRC introduce arbitration and operate negotiation, mediation and arbitration process simultaneous, like WTO(World Intellectual Property Organization), it will support content business dispute resolution more amicably. Also it will be expected to contribute to contents industry in Korea. Contents Disputes are so affordable to arbitration, specially Korea branded Contents likewise K-POP, Drama have gone overseas so much that many international disputes on contents happens considerably. There was also some arbitration cases which managed entertainments disputes in Korea. This paper investigates some usefulness on arbitration and appropriateness of adopting arbitration rules to CDRC and check any other Korean and Foreign organization which provide mediation and arbitration at the same time. Conclusively I think that it s time to examine the adoption of arbitration in CDRC, and I hope this study will be a start point at this part.
