행정절차법에 있어서 신청·신고에 관한 검토

국문 초록

행정절차법은 사인이 행정에 대하여 행하는 행위로서 신청(제2장 제1절 제17조)과 신고(제3장 제40조)에 관해 적용법조를 달리하여 규정하고 있다. 신고 중 자기완결적 공법행위는 사인의 공법행위로서 효력을 발생하고 행정청의 별도의 조치가 필요 없지만, 신청 등 일정한 행위요건적 공법행위에 대해서는 행정청에게 처리의무 즉, 응답의무 또는 신청에 따른 처분의무가 부과된다. 행정절차법은 신청과 신고에 관하여 구체적인 규정을 두고 있지 않으므로 법해석·적용상 명확하지 않다는 문제가 있고, 양자는 사인이 행정기관에 대하여 행하는 사인의 공법행위로서 유사한 점과 적용법규의 차이 등으로 인해 다른 점이 있다. 따라서 행정절차법에 있어서 신청과 신고의 법률 해석·적용상의 문제점을 해명하고 공통점과 차이점을 밝히고자 한다. 이를 위하여 처분의 신청과 신고의 법해석·적용상의 문제, 그리고 신청과 신고의 이동점 등에 관하여 검토한다.

영문 초록

Administrative Procedure Act stipulates the Applications for Dispositions and Reports as an act of public law of private citizen. Administrative Procedure Act Article 17 clause 4 stipulates that Applications for Dispositions to say “Any application for disposition to an administrative agency shall be made in writing. Where an administrative agency receives an application, it shall not reserve or refuse the acceptance thereof or unjustly return such application, except as otherwise specifically provided in other Acts and subordinate statutes, etc. and shall issue a receipt thereof to the applicant where it accepts the application.”And article 40 Clause1 stipulates that Reports to say “Where Acts and subordinate statutes, etc. provide for reports that release a person from a liability by notifying an administrative agency of specified matters.” There are similarities and differences between the Applications for Dispositions and Reports in Administrative Procedure Act. This paper, by examining several issues concerning the Applications for Dispositions and Reports, and problems of their interpretation and application on the Administrative Procedure Act is apparently trying to figure out the similarities and differences between the two systems and solve the problems of their interpretation and application.
