감사원의 지위에 관한 헌법적 고찰-감사원의 기능과 소속에 대한 비판적 검토를 중심으로-

국문 초록

현재 감사원은 정부와 공공부분의 회계 및 경제적 운영에 대해 검사하는 최고의 기 관이다. 따라서 감사원은 헌법 제97조와 감사원법 제20조의 규정에 따라 국가의 세입• 세출의 결산을 검사하고, 국가기관과 법률이 정한 단체의 회계를 상시 검사•감독하여 그 집행에 적정을 기하며 행정기관의 사무와 공무원의 직무를 감찰하여 행정운영의 개 선을 추구하고 있다. 이러한 감사원의 권한 또는 직무 범위는 독립성이 침해되지 않도록 헌법 제97조부터 제100조까지 그 설치 근거를 두고 있고, 또한 대통령 소속 기관으로 되어 있으나 직무에 관하여는 독립된 지위를 가지고 있다. 그러나 감사원의 독립성 확보를 위해서는 독립기관화 되어야 한다. 다시 말해서 감사원 본래의 업무를 추진하기 위해서는 완전한 독립성을 확보하여야 하며, 감사원은 집행부와 입법부에 대하여 독립적 지위를 가질 수 있도록 헌법 및 관련 법률을 개정하여야 할 것이다.

영문 초록

The Board of Audit and Inspection(BAI) is the Supreme Audit institution for checking the accounts and economic management of the state and the public sector. According to Article 97 of the Constitution and Article 20 of the BAI Act, the BAI examines the final accounts of revenues and expenditures of the state. It audits the accounts of the state organizations prescribed by the laws, and also inspects the work performed by government agencies and the duties of their employees. The BAI is a constitutional agency whose organization, status and functions are clearly written in Articles 97 to 100 of the Constitution. The BAI is established under the President of the Republic, but it retains independence in performing its duties. It also examines the final accounts of revenues and expenditures of the state and reports the results of such examinations to the President and the National Assembly the next year. In other words, the BAI needs to ensure complete independence and it should revise amendment to the constitution and the related regulations to achieve an independent position from the executives and legislature.
