국문 초록

막스 베버의 이상형의 관료제 모형은 국가사회를 조직화하고 발전하는데 유용한 제도라고 본다. 그 러나 관료제도는 여러 가지 병리현상과 부패를 야기하였고 이를 제어내지 통제하지 못해 망국으로 치 닫고 국제적 이슈로 부상하였다. 각 나라 마다 관료부패병을 퇴치하기 위한 노력은 상당하지만 성과는 미미한 것이 사실이다. 원래 부패라는 것이 보이지 않고 은밀하여 단일의 법제도로 통제하기는 여간 어렵다고 본다. 그래서 각 나라들은 여러 가지 방안을 만들어 시도하곤 한다. 본 논문은 한국관료부패 의 문제를 다룸에 있어 법제도적 대응전략이나 시민사회의 강화방안을 고찰하였다. 특히 국민권익위 원회의 반부패시스템과 공익제보시스템의 기능을 살펴보았다. 본 논문은 국민권익위원회 뿐만 아니라 감사원, 검찰의 기능도 강화하여야 한다고 보았다. 이와 같은 점을 주목하고 문제를 해결하기 위한 연구방법은 다음과 같다. 먼저 문헌연구와 국민권익위원회의 정책보고서 등을 참조하였다. 두 번째는 언 론기관과 해외학자들의 연구서를 분석하여 논의의 중심맥락을 정하였는데 초점은 다음과 같다. 1.부패의 정의와 개념을 분석하였다. 2.반부패정책기관의 정책적 대응기능은 무엇인지 분석하였다. 3.한국투명사회를 만들기 위한 영향요인은 무엇인지라는 의문에 관심을 두었다. 이를 위해서 한국 반부패정책 기관들의 반부패 역할과 기능, 방향은 무엇인지 고찰하였다. 다음은 본 논문의 중심내용이다. 첫째, 국민권익위원회의 기능을 고찰하였고, 최근 공직자 알선청탁금지법 제정이나 정책적 노력을 고찰하였다. 또한 공익제보 활동의 기능도 검토하였다. 둘째, 사정기관인 감사원이나, 검찰의 기능과 방향은 무엇인지 고찰하였다. 감사원의 독립성이나 감사시스템의 문제를 극복할 수 있는 점이 중요하다고 보았다. 셋째,한국시민사회의 노력, 대안제시 등 반부패전략과 투명사회의 방안이 무엇인지 살펴보았다. 이를 위해 한국시민사회의 문제점을 파악하고 제도적 개선방안이 무엇인지 고찰하였다.

영문 초록

The Korean society has a dual perspective toward the bureaucrats' roles and morals. They are implicitly expected to work better and be more ethical than other people do. This makes them often pretend over-upright and more desirous of social success. In this circumstance, passive and easy-going attitudes, converse of means and ends and government-first behaviors fuel the flame of corruption. Unless such traditional attitudes are eradicated the possibility of corruption will always exist. In this paper, I focus on how to combat corruption and institutionalize global trends and analyze methods of regional and transnational collaboration. I also attempt to cast light on corruption from many different viewpoints. Focusing on the k-acrc and civil society world, it mainly deals with anti-corruption infrastructures and preventive systems. Key points the author emphasizes are as follows: First, to introduce the cases of the K-acrc that were noted for their successful CPI index stories of combating corruption; Second, to analyze each role of the characteristic of corruption in civil society in Korea and to scrutinize their problems; Third, to understand the current administrative situation of Korean corruption and to suggest possible countermeasures, focusing on the Board of Audit and Inspection of Korea and the Criminal Prosecution System in Korea. This study approaches the anti-corruption systems in Korea generally and provides a theoretical foundation for eliminating corruption in Korean society and for recovering the public Governance.
