지방의회의원 행동강령 운영실태에 관한 분석:지방의회의원 행동강령 시행 전·후 비교를 중심으로

국문 초록

본 글은 지방의회의원 행동강령(대통령령) 시행 이후 지방의원 행동강령 위반사례의 변화정도와 지방의회의원 행동강령 조례제정 현황을 통해 지방의회의원 행동강령의 운영 실태를 파악하는데 목적이 있다. 실태파악 결과 지방의회의원 행동강령(대통령령)이 시행된 이후에도 과거와 달리 지방의원의 도덕적 해이 및 예산낭비와 같은 부패행위가 개선되지 않는 것으로 파악되었다. 이러한 상황에도 불구하고 지방의회의원 행동강령 조례제정이 매우 미흡하며, 특히 17개 광역의회에서는 모두 조례제정을 하지 않은 것으 로 나타났다. 이러한 결과는 지방의회의원 행동강령의 추진전략으로 기관 자율성에 근거한 청렴형 보다 법규정 정비 등과 같은 제도적 노력이 수반되는 규정준수형이 현 시점에서는 더욱 더 설득력을 지닌다고 할 수 있다. 또한 반부패정책의 연관성 차원에서 공공기관 청 렴도가 높은 지방자치단체일수록 또는 공공기관 청렴도가 낮은 지방자치단체일수록 지방의회의원 조례제정에 적극적인 의지를 보일 수 있다는 가정에 따라 이들 관계를 탐색적으로 분석해 보았다. 분석결과, 기초의회 중 시•군은 공공기관 청렴도가 높은 기관 일수록 반면 자치구는 공공기관 청렴도가 낮은 기관일수록 지방의회의원 조례제정에 적극적인 의지를 보이는 것으로 나타났다.

영문 초록

The purpose of this study is to grasp operation status about the code of the local assemblyman conduct(as a presidential decree) through between violations of the code of conduct and the present condition of the code of conduct by ordinance-making, after implementation of the code of the local assemblyman conduct. As analysis of current status, corrupt acts such as moral hazard and waste of budget of the local assemblyman are no different from the past. Despite this situation, ordinance-making of the code of the local assemblyman conduct is very insufficient. Especially, all of 17 metropolitan councils have not enacted the code of the local assemblyman conduct by ordinances until now. This result means that integrity approach more than compliance approach is powerful here and now. As a result of analyzing relationship between the integrity of public institutions and the ordinance-making of the code of the local assemblyman conduct, I found that the code of the local assemblyman conduct by ordinance-making in the city council and district council was actively formed in public institutions with high integrity. On the other hand, in the case of autonomous district, the code of the local assemblyman conduct by ordinance-making was actively prone to happen in public institutions with low integrity.
