경찰의 선거수사 현황과 대응역량 강화방안에 관한 연구

국문 초록

자유롭고 공정한 선거 확립은 자유민주주의 국가에서 매우 중요하다. 선거과정에서 경찰의 역할은 투명하고 공정한 선거 구현을 위한 선거사범 단속•처벌과, 후보자 등 주요인사 신변보호 활동, 유세장 및 투・개표 경비 등에 걸쳐 있다. 그러나 현실적으로 선거사범 단속을 위한 수사역량을 확보하는 데 있어서 범죄의 은밀성, 조직성, 당파성, 금품향응제공의 음성화․지능화 양상 등 선거범죄의 특성상 여간 어려운 것이 아니다. 또한 불법선거 행위를 감시•단속하는 국가기관인 경찰과 검 찰, 선거관리위원회 등이 선거사범 단속과 처리에 있어서 상호 기능이 중복되어 있고, 기관 간 상호 공조체계를 형성하고 있으나 보이지 않는 경쟁과 긴장으로 인해 수사상 어려움을 겪기도 한다. 경찰은 자체 인지사건 뿐만 아니라 선관위의 고발 또는 수사의뢰받은 사건을 처리하거나 검찰이 이첩한 사건을 수사한다. 이런 이유로 선거법 위반 단속사범이 상대적으로 많을 수밖에 없다. 특히 단속과 수사에 있어 큰 축을 담당하고 있는 경찰로서는 내부적인 수사역량 강화가 매우 중요하다고 할 수 있다. 위와 같은 문제인식에 기초하여 본 연구는 선거사범 단속의 한계가 어디에서 비롯 되는지 그 문제점과 실태를 분석하고, 선거범죄의 예방대책과 제도적 개선방안을 제시 하는 데 그 목적이 있다. 특히, 불법선거 행위를 감시•단속하는 3개 기관 간 관계를 고찰하여 선거사범 단속을 위한 협조체계 강화 방안을 제시하였다. 또한 선거사범 단 속기관인 경찰과 검찰의 단속현황에 대한 비교분석과, 선거수사전담부서인 경찰청 지능범죄수사과 관계자와 경찰관과의 심층면접을 통하여 경찰의 효과적인 선거수사 역 량 강화를 위한 제도적․정책적 개선방안을 제시하였다.

영문 초록

Free and fair elections system is very important in democratic democracy nation. Therefore the police, prosecution and national election commission exist for secure the freedom and fairness of the election and they observe and crack down any illegal activities during the election. The national election commission request or report any illegal activities to police and prosecution, then the prosecution arrange the requested case or transfers most of case to police. Also the prosecution receives some cases from police and takes a response of institution and support of a public action it. As mentioned, the roles of these three organizations are quite different, but they are closely connected each other. However, the police face with many limitations that process of election crime investigation. Resultingly, the police take passive action on election irregularities because of its specialties or public and internal reason. There are several difficulties which make police take passive action on election irregularities. The purpose of this study is to explore the enhancing of police’s election investigation capability in South Korea. Especially, the directions for counter measures were suggested improving capability of recognizing election irregularities by police, reinforce the training system of police officer, enhancing of election investigation techniques, and building cooperative governance system with interagency(prosecutor, national election commission) and non-governmental organizations.
