자배법상 ‘자동차사고 피해지원사업’의 문제점과 개선방안에 대한 고찰

국문 초록

자동차는 달리는 흉기라고 불릴 정도로 우리의 일상생활 곳곳에는 자동차 수만 큼의 다양한 사고 위험이 존재하고 있다. 이러한 자동차의 운행으로 사람이 사망 또는 부상하거나 재물이 멸실 또는 훼손된 경우에 손해배상을 보장하는 제도를 확립하여 피해자를 보호하기 위해서 ‘자동차손해배상보장법’(이하 “자배법”이라 함)이 도입되었다. 하지만 자배법상 강제보험 제도를 통해 손해배상의 이행확보 조치가 마련되었다고 하더라도 뺑소니 사고나 무보험차량에 의한 사고로 사상당한 피해자에게는 동 보험의 보호가 미치지 못하게 되어 결국 손해배상을 받지 못하고 방치되는 결 과가 초래된다. 이처럼 자동차 사고를 야기한 차량이 무보험이거나 뺑소니 사고 를 일으킨 경우에 피해자를 보호하기 위한 방안으로 마련된 것이 ‘자동차사고 피 해지원사업’ 중 ‘자동차손해배상 보장사업’과 ‘자동차사고 피해자 가족 등 지원사 업’이라고 할 수 있는데, 이번 논문에서는 이 두 가지 제도의 문제점들을 파악해 이에 대한 개선방안을 제시하였다. 먼저 ‘자동차손해배상 보장사업’의 경우는 낮은 보상한도의 문제, 위탁 보장사 업자들의 업무처리 시 도덕적 해이(Moral Hazard) 문제, 구상채권의 관리 미흡 문제, 자국민의 해외 무보험 ․ 뺑소니사고 시 피해자 보호방안의 부재 등에 대한 문제점들을 분석하고 해결방안에 대해 살펴보았다. 다음으로 ‘자동차사고 피해지원사업’ 중 자립지원금과 ‘장학금’, ‘생활자금대출’, ‘재활보조금’ 제도의 문제점들과 개선방안에 대해 검토하였다. 끝으로 ‘자동차사고 피해지원사업제도’의 효율적 운영을 위해서 ‘자동차손해배 상 보장사업’의 사업주체를 지금처럼 ‘정부(국토교통부)’로 하는 것 보다는 주요 선진국에서 운영하는 방식과 같이 법률상의 자동차손해배상 보장기금을 통해 보험사업자 등으로 구성된 특수법인 형태로 운영해서 보장사업제도의 효율성을 제고할 것을 제안하였다.

영문 초록

The purpose of Guarantee of Automobile Accident Compensation Act(GAACA) is to establish a system by which compensation for the death or injury of any person and the destruction or damage of any property caused by the operation of automobiles is guaranteed in order to protect victims and to promote the sound development of automobile transportation. According to ‘Guarantee Business of Compensation for Loss Caused by Automobile’, the Government shall, upon the claim of a victim, compensate a victim for the loss incurred within the extent of the insurance money of the liability insurance, where a person was killed or injured due to an accident caused by the operation of an automobile whose owner was unidentified(namely uninsured vehicle accident or hit and run, etc). Also according to ‘Automobile Accident victim s family, etc Support Project’ the Government may render aid to the children and the dependent family member of persons killed due to the operation of automobiles or of persons handicapped with serious aftereffects so that they may settle the problem of straitened circumstances, of giving up studies, etc. due to economic difficulties, and to help persons handicapped with serious aftereffects be rehabilitated. Meanwhile, the above two systems have played a number of roles for the protection of victims, but I looked at the problems and improvement of the above two systems in this paper. I look forward to the improvement of the system through these efforts.
